My manager told me I wouldn't be able to carry over 3 weeks annual leave remaining from 2008....so I used up 2 weeks in March, and he told me I'd be able to carry over a week to 2009-10......
I was booking some leave last week, with relief manger, I saw the screen didn't have my carried over week.
Relief manager didn't investigate, but did tell me that definitely I hadn't got a week carried over.
Can manager take my week off me like that???? Can I demand my week back? Obviously I should have got original promise in writing, we live and learn.....
Also I worked on new Years day, which was due to be my day off anyway. Am I right in thinking I should have got a day off in lieu for that?

We are told in NIMC that we can't carry over more than a week, so count yourself lucky!!

errrrrrr, yeah , thanks for that jack, that's what I'm asking.....
I only had a week left to carry over, but manager hasn't done it for me.........What you're saying is I should be able to have the week carried over?
I count myself UNLUCKY , cos he's taken a week from me.....

You should have got it in writing.
But you are entitled to that week, and should ask the manager to
give you the dates (in writing) when you had Annual Leave in the
last AL year, which should show you did not take your full allocation.
You only need written permission to carry over leave if it is more
than one week (or 5 odd days).
If not taking that week meant you had less than four weeks leave in the
last AL year, you should have been asked to confirm in writing that you
were willing to forgo your statutory leave entitlement under the Working
Time Regulations 1998. Ask him if he has your written consent.

I don't know about the New Year's Day in lieu - you delivery guys do things a bit different from MCs,
but I would have thought you should get a day in lieu. But perhaps someone from Deliveries could
confirm how that works.

In MCs, if we work a Bank Holiday, we claim for it on a docket,
you can choose either:
Option A - 1.5x OT rate plus day in lieu, or
Option B - 2.5x OT.
So if you got paid 2.5x for the New Year's Day you would not get a day in lieu.
If you chose the Day in Lieu option, it should be credited to this year's holiday entitlement.
