STAGE 2 WARNING URGENT HELP NEEDED

ONE OF MY COLLEAGUES WAS RUSHED TO HOSPITAL IN JANUARY 2008 AND HAD 2 MAJOR SURGERIES ON HIS LEG,HE WAS THEN HOSPITALISED FOR OVER A WEEK AND WAS RELEASED HOME TO RECOVER FOR MONTHS, WHILE RECOVERING HE WAS TOLD HE WOULD NEED FURTHER SURGERY TO MAKE THE FULL RECOVERY, HE WAS THEN SEEN BY ATOS WHICH HE MENTIONED ALL THIS TO THEM, IN HIS REPORT FROM ATOS THEY STATE THAT IF STARTING BACK BEFORE HE WAS SEEN BY HIS CONSULTANT, ALL TREATMENT/SURGERY SHOULD BE TREATED AS THE SAME ABSENT, JUST BEFORE HE WAS SUPPOSE TO SEE HIS CONSULTANT HE REVIEVES A THREATENING LETTER BY HIS DOM, THREATENING HIM TO START BACK IN WORK ON A CERTAIN DATE OR HIS PAY WOULD BE CEASED, HE THEN STARTS ON THIS DATE AS HE HAD ALREADY BEING ON HALF PAY FOR MONTHS AND AFRAID OF THIS THREAT BEEN CARRIED OUT, A WEEK LATER HE SEE'S HIS CONSULTANT AND THE CONSULTANT SUGGEST'S FURTHER SURGERY THE FOLLOWING WEEK, SO HE REFUSES SURGERY DUE TO THE PREVIOUS WEEK'S THREAT AND CARRIES ON DOING HIS WORK IN AGONY, MONTHS LATER HE RECIEVES A LETTER TO GO INTO HOSPITAL FOR SURGERY, WHICH HE WAS THEN OFF FOR MONTHS RECOVERING AND MOST OF IT WITHOUT PAY, HE THEN STARTS BACK LAST WEEK AND TOLD HE'S BEING CONSIDERED FOR STAGE 2 WARNING, TODAY HE'S JUST BEEN TOLD THAT THE MANAGER HAS DECIDED TO GIVE HIM THE STAGE,

THIS MUST BE WRONG ? Something similar happened to me--although it was my boss who told me my abscenses would
be counted as one. On return to work following surgery,another boss tried to give me a warning..I just told them if they tried that I would take them all the way.Stand up for yourself---not nice-but it works--most of these Managers are just
big bullies, and the minute you threaten them, they back down. If your mate had a good work recoerd prior to this, it will work in his favour--also, ifyou live in Scotland, which I hope you do, any letter which is threating in content, is against the law.They can only relay to you a course of action has been taken,rather than threaten that action.
just point that out to them, and watch them deflate.

THANKS I'LL INFORM HIM ASAP, THE ONLY TIMES HE'S BEEN OFF WORK IN THE LAST 3 TO 4 YEARS IS FOR SURGERY, AND BEFORE THEN IT WAS SURGERY DUE TO AN ACCIDENT AT WORK,

Yet another example of how Atossers and RM treat sick staff!
They are supposed to treat people as genuine and take circumstances into consideration,but there more bothered about ticking boxes and arselicking upto the next up in the line of command...oooh look at me I gave out 5 stage warnings this week which could go on and get somebody later on down the line sacked arn`t I good. :evil/mad
I hope your friend has a copy of the Atos report then he can shove it under the arrogant managers nose,good advice off Stokes if you don`t stand upto them they will issue a stage 2,you could also mention the sawyer report infact anybody who is facing a stage warning for hospitalisation should use this.

Your friend's illness is genuine and yet he is treated like this, this is not right and your friend has a good chance I would have throught if it went to an employment tribunal. Your friend has done the right thing by going through the grievance procedure and if he is not successful take it to an employment tribunal. A member posted this website regarding RM court cases and unfair dismissals in regards to sick absences, in which the major of cases they have losted. Your friend should take a look at these cases:

just been informed now that he recieved a letter from his cluster manager informing him that he's not accepting his grievance, as no grievance can be made against stage 1 nor 2 as they have appeals at stage 3, yea out through the door you mean, but his grievance was adviced to be against management not using there guidelines and hospitalisation should be discounted from stage warnings, he is now seeking advice off equality and human rights, he feel's he's being bullied out of royal mail has he has submitted a claim against the company sometime ago,

You have no right of appeal against stage 1 and 2, but you have the right to put in a grievance any time you feel it is warranted. I put a grievance in against my stage 1 hearing and won, because the ATOS lied and my manager was using their evidence to issue me with the warning.
