I have a tribunal coming up against RM for B&H. CWU wouldn't help so am doing it alone.

Does anyone know of any cases won against RM for similar? I am looking for precedents to include in my case. Have searched online, but can't find anything detailed.

I'm claiming constructive dismissal because of long term B&H & victimisation. I don't want to go into too many details yet.

Having been involved in a high profile case including ET myself & having talked for many hours with lawyers etc,you will find the experience stressfull, but with your case I do know that constructive dismissal is very complex & hard to prove especially with no legal expert on your side, RM will have a very good Barrister probably QC, but I do wish you the very best of luck.

I am not sure what type of harassment and bullying you have been experiencing. This would make things more easier, to give you more information.

There is one particular case of racial harassment and bullying the Jermaine Lee case (goggle his name) this included bullying and harassment by colleagues and managers, you can use any case law regarding bullying and harassment as evidence to back up your claim as long as it is relevant to your case.

You said that you suffered from long term bullying , harassment and victimisation, have you log all you complaints to management and the union. Are you claiming constructive dismissal because nothing as been done to combat the bullying and harassment and when you have put in a grievance or made complaints about your bullying and harassment you have been victimised, do you have witnesses that will also back you up.

Have RM followed their own bullying and harassment policies? If you look on the RM website you can find information on diversity: harassment and bullying at work you can also use this to fight your case. Download or try to print policies regarding RM bullying and harassment this will come in handy at employment tribunal, espeacially if they have not followed it.

You can also see an employemnt lawyer free for 30 mintues, they will point you in the right direction and probably give you additional information that you cannot see yourself. Good luck.

Hi. Saru---If you have a H.R.M stationary Office nearby,go in and purchase past Cases, they can be an invaluble start.
The library may also be a source.And there are some helpful sites on the Web, just got to keep looking!
Representing yourself can be hard, but you can also win if you have right on your side.

That's a wise decision. You don't want to prejudice the case.

Have you looked into the possibility of getting Legal Aid?
I don't know if it's available in this type of case. But if it is, then at least you'll have a Lawyer to help you.

Have you looked at your household insurance, most household insurance now has legal cover with it, mine is for £50,000 and covers employment contractual disputes amongst other things

Meant to say that once you lodge papers with the tribunal,
they are open for inspection, and you may get a no win-no fee company contacting you. They can be a good thing sometimes, so do not dismiss them.

Might be worth trying the Citizen's Advice Bureau - they can sometimes
refer you to newly qualified or trainee lawyers who might do give free
legal advice or representation, to get experience.
