Unfortunately the title of this thread does not refer to a brilliant holiday i've had.

I have been off sick since January, just returned last week. I should of had 2 weeks holiday in that period, but as i was off sick ( damaged ankle) i din't have a holiday as such, unless you include being confined to the sofa and trips to the docs and physio.
Now that i've returned to work, there are not enough days left in the current holiday year to take 2 weeks off. I'm not sure that i would want a week off next week as i've been stuck indoors for nearly 2 months anyway.
I understand that under the Way Forward agreement, 5 days can be carried over to next year, i have no problems with that. But what happens to the rest of my entitlement?
Also i understand that i have to sign off my entitlement to this years holiday for them to do anything as well.
It's just that my DOM has not mentioned it at all ( no suprise there, he probably thinks i have forgotten it).
But does anyone else have any experience of this situation that might be able to shed some light on what i should do?

you can only carry 1 week in to summer or you could come to an agreement with the manager if you trust him but getsecond week sooner rather then later

or ask for 5 leiu days and 1 week and come to an agreement with the manager for dates if hes ok

I thought ther was some sort of High Court case recently, the upshot of which was that workers on long term sick leave are still entitled to the holidays they have accrued.

Obviously that is a general settlement, but presume all employers would have to abide by it.

If you've got 2 weeks left,then 1 can be carried over no problem,the other at the managers discretion can be carried over as well.
I'm not 100% but the manager could force you to take a week before this year finishes.

We had a bloke that came back after having 6 months off,a week or so later he was on holiday for about 3 weeks as he had to use it up. :crazy:

Yes savo as far as i'm aware and if you use the above situation,they can't just dismiss your accured holidays because you have been off long term.

Way Forward - Annual Leave

Transfer of leave in excess of these limits (five days/1 week) requires written permission
from the line manager, except that leave that cannot be taken due to sick leave may be
allowed in the following year
. where this is granted and would reduce the annual leave
taken in a particular year to less than four weeks, the individual must also confirm in
writing that they are willing to voluntarily forgo their statutory leave entitlement under the
Working Time Regulations 1998.

The rules are that you can carry over 1 week with the managers authorisation. In extreme cases, which would be yours, you can carry over more but it has to be in writing by both parties so that neither can screw the other probably.
You should see your DOM and ask him if you can carry over the 2 weeks as permitted by RM due to extreme circumstances. If he says OK then give him a letter stating this and requiring him to write back. If he says NO you cannot then see your rep or area rep as the DOM is talking horsesh*t. Hope this helps

what if your on long term sick and bank holidays accur during your illness
ie xmas day, boxing day ,and new year
can you claim these back to

I wouldn't think so, as RM pay you automatically for these days. If you were actually due to work on a public holiday, then i think it may be different, but we don't as a rule.

I have 20 hours of banked time.

Do I have to take these by the end of the finacial year?

Was planning on taking these early May??

What do you mean 'banked time'! There is NO banking of hours!!

AFAIK there is no National Agreement on "Banked Hours" YET - so you will need to read the local agreement and get guidance of the local rep as well.

Sorry "Poptart" but I never cease to be surprised what gets agreed locally when there is no National agreement to base it on.

Until you come up against a problem such as the one you yourself have identified. The problem is that even though you have accepted and agree with Banked Hours you are still not sure of the details. This is not a criticism of you rather than of having local agreements that have not yet been trialled or agreed on a National Basis. Trials and National agreements help to provide a blueprint of a local agreement and help highlight problems that local units may have not considered or even been aware of.
