Right, just wanting to know if anyone knows what the timescales are for ET's (Employment Tribunals) are from start to finish? I know someone who has lost their job through unfair dismissal under the attendance procedure and subsequently lost their appeal. Whats the norm here, whats the payout "ball park figure" if the claim is successful or will RM more than likely offer "out of court"??

The timescale varies depending on the nature and complexity of the case. But whenever they can, RM settle out of Court, to avoid loosing.

You rarely get any payouts, beyond lost wages. But you do generally get your job back, once you've proved them to be at fault. Although nothing's ever certain. And they usually drag things out as long as possible.

Just tell your frind, not to let them grind him/her down. They count on people giving up. Don't let them have the satisfaction!

It seems to take about 9-12 months for a case to go to an ET usually.
An ET can recommend that someone is reinstated but cannot compel the employer to do so,
though usually they would, except where they may want to get rid of someone they consider
to be a 'problem' such as a union activist.
Any compensation would take into account the level to which the ET may think the person may
have contributed towards his/her dismissal.
As far as I am aware the maximum award (if not reduced by any contributory factor) is about
the equivalent of three years pay.
The employer may offer a settlement at the last moment (as with the Bristol 3) if they think they
are going to lose, but will drag it out until the last moment in the hope that the person will be
ground down by the stress and walk away.

Cheers guys, I know my friend will not walk away as they have and always will have the "bring it on" attitude. Unfortunately, they are or were an activist so dunno if this will alter the course for them... all I can say is I wish them the best of luck and hope they get what they want in their goal...

lucky for you if you can get help from the union . my branch was unjustly suspended and my first I,T forms where lost in a pub.
then as we had some some some no i wont say it. then we had a person running the affairs of the branch but he was never there and went missing for six weeks at a time :cry when he did show up it was for 2 hours on a tuesday.
my I,T now is up s**t creak and so am I because its after the 3 months timescale. rm want me to pay costs because the union have told me to do one and are now not backing it. oh well not to worry cant take knickers of a bare ass.

as for the union officials who told me to do 1 . maybe see you in court :Very Happy

:nana If your rep. advised you going to a tribunal, and through his (Their )negligance) you are now between a rock and a hard place-fight back, and go to outside, free, advisory bodies. and do not give up--some may tell you not to bother(usually because they can't be)-but others can be really helpful--there is always a way if you look for it--Good luck.

SORRY Andy but you have got that wrong in ET'S you rarely get your job back,even if you have a watertight case, as my case was which took 13 months to get resolved, it was pressure from the CWU & the serious threat of industrial action in Bristol that worried RM, if you win your ET you normally get loss of earnings the minimum comp payout of £3,000, you would get about a years wages in total, that is what my barrister told me but she was also going for loss of pension which was final salary pension, which if the chairman agrees to, can be a large lump sum depending on amount of service.for eg 15 years service pension loss was about £15,000 + loss of earnings +basic comp payout.

correct ! - that's a form of subtle or verbal bullying , RM will initially threaten you with costs as a naive ruse , if they do that report that to the Tribunal , and get a adverse inference drawn against RM - as it shows how underhand they are , they're only interested in saving their sorry arses due to the possibly bad PR that they've to " manage " .

It's basically " Be a good boy and go away as the Union don't think you've a strong enough case " - it's more complicated than that due to the politics with or without a small P .

There will be more forms of bullying afterwards - you have to stand up to them , if the bullying doesn't work , RM will get their solicitors in to do their dirty work .

There should be a preliminary hearing , the Tribunal will decide if you are being a pain in the arse ; it's not up to RM to play judge , jury and executioner though predictably they will try and do that :evil/mad .
If and only if only then , the Preliminary hearing decides you are being a pain in the arse , then you will be warned that if you carried on and lost you will be liable for costs .

the union wouldn't look very good , would it - you can get a mirrored culture - to RM , people are loose canons ; to the Union they're sh** stirrers , some are more used to a time when RM was relatively benign , it's more Office Rottweillers these days

mirrored culture...so true...for so long it has all been so cosy and the union have been able to fob members off with this sort of spin...the problem now is what you have often said in your postings...Royal Mail are no longer a benign employer, they really mean business...I heard Adam Crozier had sarcastically said he will modernise the CWU if the CWU will let him...I hate to say it, but he has a point......
