Put on stage for being sick thru bullying?

Hi everyone,

Can someone rightly be put on an attendance stage warning for being off with stress (with a doctors note) due to bullying and harrasment? It would seem grossly unfair if someone was punished/disadvantaged for being nothing more than a victim?

If said harrassment was from a manager that means they can effectively harrass someone untill they are off enough times/long enough that they can sack them for poor attendance?

What a total disgrace of a system, which I assume is designed to protect the company from employees who are not committed enough to the job.

If you were being bullied, did you see your union rep or take out a grievence?

If you were being bullied, did you see your union rep or take out a grievence?
that's the problem , if you had something in black and white that you'd reported it - RM would have to hold fire . The 22 million dollar question if sacked is " Did RM act reasonably ? "
If you did "tell tales out of class " ( I'm sorry but this is the juvenile mentality of some RM managers ) - RM would see you as a loose cannon , they would still try and get rid of someone but they'd have to be more devious , subtle and underhand about it .

It all boils down to this , to RM it's "better " to wear somebody down and hound the target out of the door as there's every chance the target won't give RM any problems . The other scenario is 1 . RM would have to admit they've a problem - RM DO NOT do responsibility - never have , never will - very negative style of management 2 . IF they did take action , they'd have a loose cannon of a manager with a bitter , twisted grudge & chip on his shoulder that could cause RM more problems than the target .

However there is a tick list question on RTW forms about H&B issues - that is purely to cover RM's sorry a*** if somebody takes things outside the PO . If you stated there was but the manager didn't flag anything up " to keep things down " - RM have failed in their duty of care .

RM can then work in the following ways to wriggle out of things - they will say you never reported it officially , took action so therefore it didn't happen - arrogant - yes ! but that's what they'll do .

If anyone raised matters outside RM after being sacked , RM will wriggle out of it by saying you never raised a grievance and you are abusing the Tribunal system to cause a stir and being a troublemaker . RM would not hesitate to use expensive legal people to stop a tribunal .
MURDERERS. Need to dispose of a body? Simply parcel it up and post it to yourself via DHL. You will never see it again.

I walked out of the job a couple of years ago due to B&H (not the cigs!) from a line manager, I was in tears. As soon as I got home I phoned the B & H helpline and explained what happened, they were very sympathetic and sent out a B & H form to me which I filled in and returned, I wanted this dealt with through the proper channels and not just brushed under the carpet locally. I also went to my doctors and explained what had happened and was signed off sick with stress for a week, I thought I would loose my job for walking but due to circumstances it was not mentioned by DOM. Anyway within days the DOM had received the B & H paperwork and interviews started taking place, case found in my favour. I was put on a Stage 2 for the week off which I think is out of order considering I won the case. So please make sure you have put in a B & H form, you have witnesses and make sure there is a paper trail....good luck.

Thanks for responses. Yes I've had a B&H case go through and during the process I recieved more harrassment and went off sick with stress. The case was found in my favour (upheld 100%) yet for the 2weeks off stressed out they want to give me a stage warning. I can't believe they can give an atterndace warning when the absence is a direct result of managers intimidation.

:nana Hiya, If you google up Employment Legislation, you will see lots of helpful items--(Mental Health) which includes
depression. Your managers do have a duty of care to you.and matters such as this have to be handled 'Sensitively'
you could argue that giving you a warning is further damaging your health----and suggest that THEY get clued up
on up to date legislation--always remind them they have a LEGAL obligation as regards your welfare.
I once had My doctor write to them and say there behaviour was causing me stress---that stopped them!!!!
It costs 15 pounds but well worth it.

problem is that there's that much pressure from middle management , at one time RM would back off to a point , there would be local territorial and instuitionalized managers "plotting " things and there would be "coincidences " afterwards .

Nowadays it'd be " let him / her slog it out with RM in a tribunal " as there's orders from on high not to undermine local management , no matter how incompetent or corrupt - siege mentality management .

Thanks for the replies all, ended up I was put on stage 2. The manager said before a dismissal the resons for the employees stage warnings are 'considered'. This doesn't mean they wouldn't get rid of someone for being off due to stress from bullying but I guess u could take them to an employment tribunal if they did and a past harrassment case/official claim would be good evidence on your behalf.
