First off, what a great forum for posties. I found it through Google whilst trying to find a copy of the conduct code.

Now, my problem. I transferred to a new office in June 08 and started on a 30 hour delivery duty. After my first couple of weeks I had a visit from my (mis)manager asking me why I was claiming so much overtime. (12 hours a week) I told him that as I was new to the duty I was finding it hard to start with but would improve with time, which I did. It`s now an average of 8 hours p.w. Nothing more was said until October when he called me for a "fact-finding interview" over why I was claiming "excessive overtime". I told him truthfully that was how long the job took as it was way over a 30 hour duty IMO. He replied that they had it tested in July (when I conveniently was moved back to my old office for a week) and the greyhound they got to do it completed it within the duty time and was easily do-able. I told him that proved nothing as this chap would outpace Linford Christie and has a reputation for cutting all the corners and no regard for health and safety. Anyway,interview over and I awaited the outcome. Three weeks later I get a letter telling me that the case was being forwarded to the cluster manager as any decision may be above my manager`s authority. No other explanation and he wouldn`t tell me over the phone either. So another 3 weeks go by and I receive a letter from cluster manager telling me I had been charged with gross misconduct relating to dishonesty from fraudulent claiming of OT and that he had lost confidence in my trust and honesty as a postman. The penalty for this could be dismissal.

As you can imagine I was gobsmacked and started to sort out my defence, which was how I arrived here and my trawl through the conduct code. I discovered that they had made at least seven procedural errors and wouldn`t have a cat-in-hells chance of making it stick, especially as I`m innocent!

So today was the big day for the interview so I turn up nice and early to speak to my union rep. He had great pleasure in telling me he had broke the news of their procedural cock-ups to them and that wiped the smile off their faces :left:
However, instead of them coming to apologise to me and dropping the charge they instead said "interviews off, we`ve got to check some facts and we`ll have the interview at a later date" :evil/mad.

So, I`m still up for dismissal and I`ve probably got to enjoy worrying about it all over Christmas.

Wouldn't give it a second thought,dot your i's cross your t's do it by the book. If they could have proceeded ,they would have.

Just shows you why this companies going to the dogs. One guy does his job conscientiously, takes his time, no running, no misdeliveries etc and he is threatened with dismissal. Another guy belts round cutting all the corners and is obviously seen by the management as a shining example. I despair when I hear stories like this.

The outcome has already been decided - if they thought they were right you'd be gone - they are obviously wrong and have decided to save face - have a good christmas :Very Happy

Keep all your paperwork, especially about the procedural errors and of they do dismiss you you'll win any ET.

It also might be a good idea to keep some of the recent press statements that Royal Mail have made about not making anyone work more than they are capable of. :Very Happy

Sadly nothing shocks me anymore with regards to the way management treats posties,how the hell can you get sacked for claiming o/t that you have worked,if I were you mate I would cut off everyday, I would'nt work one minute over my time & I WOULD NOT USE MY CAR, you should cut off now during xmas pressure that will really piss them off I would ,that manager is a disgrace.You will cause him a major headache if you leave work just make sure your out there to your time,they don't give a s**t about you so play them at there own game,I was sacked for something as pathetic as that aswell god it really makes me evil. :evil/mad :evil/mad :evil/mad :evil/mad

The manager concerned put in an appearance today but surprise, surprise he didn`t speak to me. If they don`t carry on with the conduct code I`m seriously thinking of sueing the b****** for deformation of character. I think it`s a bloody disgrace that they think they can get away with this sort of thing.

Again .do it by the book and cover your back. TBH your manager sounds like an inadequate bully who picked on the wrong person this time. But be vigilant because those types are vengeful and bitter :roll:

it would also possibly have to stand up in a criminal court - very nasty accusation - reading between the lines , it sounds if this sad individual has been overruled .
I agree with Belai about bitter , vengeful & twisted RM managers

that needs flagging up to Bob Gibson , especially as he is ( apparently ) on the warpath
MURDERERS. Need to dispose of a body? Simply parcel it up and post it to yourself via DHL. You will never see it again.

willful misrepresentation and malicious prosecution are very serious offenses - there may be grounds to prosecute RM - however you are coming up against a huge , very arrogant & autocratic corporation that has always regarded itself above the law and since :lfo & :cfo have operated at best at the very legal limit .

Keep all your paperwork from this case, in case you ever need it again.

Start to keep a diary - anything that happens at work should go in the diary - names, dates, times, witnesses etc; in case you ever need it again.

It may sound over the top, but if your gaffer comes for you, you'll need evidence of the harassment.

You should speak with your rep & put a grievance in against him straight away, watch him back off.
