I have heard Managers are planning to change people’s duties to include covering the enquiry office on Sunday’s over the Xmas period, as they are unlikely to get volunteers to cover it on overtime (4 hours SA). Do our employment contracts allow them to do this? :hmmmm

So keep on moving, moving, moving your feet
Keep on shuf-shuf-shuffling to this ghost dance beat
Just keep on walking down never ending streets

Sunday has always been a voluntary shift if your eyes were blue enough to get one, for me it's a family day etc for others it's their day for religion, i think you'd get a bumper claim if they told you that you cant worship this Christmas as they are to busy to let you have your sunday off to do so :hmmmm

Unless of course they change your duty to take in Sunday’s and keep you with in the working time directive?

We need someone to check their contract, my one is long past its sell by date

Can you be made to work on Sundays?
You should check either your contract of employment or written statement of terms and conditions to see if you must work on Sundays or would have to if you were asked. If it says so, you'll have to work on Sundays. If it doesn't, then the only way of making you work on that day is by a change to your contract. This is something that must normally be agreed by both you and your employer, otherwise making you work on Sundays would amount to a breach of contract.

what you have is "custom and practice".
In all your time employed by RM, working a Sunday has been voluntary.
If during the times they are looking at the custom and practice is that to work on a Sunday is voluntary then this holds the field.
Tow this line and don't deviate, you may be forced to go through the stages of disagreement so go through them it all takes time. It will get pushed back down only to go back up again.
Confused... You won't be, after the next episode of. SOAP

They've probably arranged for Agency Staff to do the Sundays.

As far as i'm aware the late evening deliveries have all been refused by the drivers in my office. Not ideal but economics say i have too :cry
