Break in service query

I along with a few others i know have had a break in service. Did 13 years at one office then had 9 months out and started at another office and been there now about 7 years. I know i lose the first lot of seniority but do i also lose out on holiday entitlement. By this i mean will i have to pay the extra for 6 weeks a year which i would have got with 20 years service? Hope it makes some sort of sense :hmmmm

You do lose seniority which is only counted on continuous employment, except in exceptional circumstances.
But for Annual Leave entitlement, the Way Forward Agreement says:

All periods of service on a temporary or permanent contract (with periods of casual service included only if
they run continuously into a temporary or permanent contract), except for those on unpaid leave, SPPR, or
with HM Forces exceeding 15 days, will count towards calculating leave due. Previous periods of PO service
may be counted for this purpose.
Way Forward Agreement, Section 4 Annual Leave - Leave Entitlements.

Which would seem that you are entitled to have previous employment counted towards Annual Leave.

I have an idea - how about holiday entitlement based on employment with ANY employer - the older you get - the more holiday entitlement - everyone over 50 should be able to choose up to a years sabbatical paid by the government according to their average pay for the previous year or total years of employment - a just reward for work ethics.

Years ago - pre-RonaldReagan and the Big Business Agenda - a lot of the big US employers did give their employees
a years sabbatical paid leave when they reached 50.

I think the idea was that it would bring them back with renewed vigour and enthusiasm for the job and give them time to plan their later lives better - maybe we should be looking at a two year break :Very Happy

If you are away on military service for say 6 months, your seniority shouldn't be affected ?

Blimey. Is that for real? Quite a few in our place have had a break in service and not one of them have had both lengths of service used for holidays. Whose the best to see in morning, union rep or straight to manager? Wonder if i can claim some back from past years :hmmmm

All service within an appropriate grade, whether on permanent or temporary basis, will count for
seniority purposes, with the exception of any periods worked on a casual contract, or during a career
break or sabbatical. Unpaid leave will count provided there is no break in contract. Service after age
60 will continue to count. However service must be continuous for seniority purposes, with periods
prior to any break in contract (due to re-employment, for example) not generally included, unless
there are exceptional circumstances applying to particular cases that are agreed at local level.

Way Forward. Section 6. Way of Working: Seniority, para 13.6

So special leave for TA military service would not affect your seniority.

Yes :dance 2 at our place have got the full 6 weeks holiday due to 2 different senorities at 2 offices totalling over 20 years.

i posted earlier on in the thread , i cut n pasted the way forward bit ,and printed it off , took it in the office and was given the 6 weeks no problem :dance
