managers asking us to work an 8hour 40min day through .week anyone know what break entitlement we would get .we work a shorter day on saturday 5 hours 20mins.if asked why he,s changing hours all you get is its part of phase 3 and flexibility.we currently get 40mins on an 8 hour shift :cfo :lfo

Meal Brakes for non-standard, as part-time and extended attendances

Part-time jobs, and full-time jobs with non-standard attendance patterns, will attract meal breaks for each daily attendance as followed, reflecting a generally pro-rata entitlement to the national weekly standard:

Attendance length total breaks probable pattern

Less than 2 hours 30 minutes none (a 10 min grace break should be provided if work permits)
2 hours 30 to 3 hours 10 mins 10
3 hours 1 to 3 hours 30 15 mins 15
3 hours 31 to 4 hours 59 20 mins 20
5 hours to 7 hours 30 mins 30
7 hours 1 to 8 hours 59 40 mins 40 or 20 + 20
9 hours to 10 hours 59 50 mins 30 + 20
11 hours to 12 hours 59 60 mins 40 + 20 or 30 + 30
13 hours or longer 70 mins 40 + 30

Pending completion of the discussions intended to conform with the requirements of the Working Time Regulations, any exceptional attendances of 15 hours or longer will attract an entitlement of 80 minutes.

The actual pattern of breaks within these rules will be agreed locally.

Where do these break times come from?

Are they a Royal Mail created break schedule?

I have been told by a manager that anybody working 4 hours is not eligible for a scheduled break, certainly not 20 minutes, possibly a 10 minute grace break (but I wouldn't hold my breath expecting this manager to allow it).

Digging around the net for legal employment details for UK workers I came across this:
"You are also entitled to a break of 20 minutes away from where you normally work if your working day will be longer than six hours"

This then means anybody working less than six hours is not by law entitled to a break.

It's all very confusing.

But the change in hours like that should not be forced on the office, I'd like to see how they tend to get a Saturday down to less than 5 hours after a break, it takes my rural delivery 5 hours what ever the traffic.

As our manger smokes he lets them take smoke breaks when they want. I wanted 10 minutes for comfort break and he objected.

One rule for one....

Yes in agreement with the CWU - its a national agreement so cannot be superseded by local management.

By law they don't have to give you a break unless you work over 6 hours but Royal Mail ave entered into a separate agreement with the CWU and that has gone beyond the legal requirement. AFAIK it is possible to take RM to a tribunal if you are not being treated the same as other colleagues, even if in different locations, therefore you and local management should have the same break entitlements as the rest of the country.

Also in T.W.F.A you can take your break in two part's and when you want not when it suit's you manager ie 20 min after 4 hour's and 20 min at the end of duty or even three 13 min and twenty 20 second break's!.

If I have an SA that runs either immediately before or after my duty is this included in the total attendance time?
