Hi guys,

Sad news for me, my absences due to panic attacks and stress have caught up with me and I have my dismissal meeting on Thursday. I'm hoping there may be a loophole though as one of my other colleagues has had more absences than me and has sneakily had the manager put them thru as holidays, also the Stage 3 was triggered on the 9th August, is there not a 1 month deadline? They say ATOS was trying to get in touch but my phone never rang!

Help, any advice needed

and the rest : ATOS ringing - corporate b***ocks - sounds like a**e covering as this wouldn't look good in a ET especially the bit about the deal when absences were changed to AL , there could be questions - have RM acted reasonably & followed national procedure never mind the written and unwritten RM procedures - + comparators with the AL fiddle

im due a stage 1, but have been back at work 6 weeks and so far nothing.

any info would be great thanks.

If you have had your stress/panic and have been being treated for this for 1 year or more you may be covered under the DDA act.

I have been treated for stress and panic since Dec 2006, how should i go about enforcing the dda act?

you need to speak to a good union rep first and also get a good doctor and ask his advice also.

If you have been prescribed medication for such problems and it is patently obvious that you would struggle without your perscriptions - the condition will last for 12 months or more you would probably would be covered under the DDA act .

This sounds a right mess : RM should have asked ATOS whether you would be covered under DDA acts in a BRF form ( Business Referral ) - ATOS is much maligned on here but they do have some MO's that naturally don't want to be cited in a Tribunal or get reported to the General Medical Council - never mind RM this and RM that !

You may need a doctors letter of certification - the other age old problem is RM managers taking it on themselves to be consultants and Doctors as they're all swinging the lead obviously - it's laughable as there's plenty of managers with colourful records - and some going down with stress problems because of all the regimentation and pressure from on high .

Seeing the union rep at 7.30 tomorrow and the doc tonight at 6.40.Looking back on the record RM has thankfully its all mostly supported and the fact that there are others in my office who have had worse absences and had them put through as holidays by the manager to keep them sweet means I'm starting to think I have a very good discrimination case.

Total days off total 22 in 3 years. 14 of those was when I was initially diagnosed with panic disorder

The trouble with RM is they only see what they want to. A few years ago nearly everyone got a Stage 1 for Flu when RM ignored the Governments advice about a Flu epidemic. Good luck though.

If they are thinking of getting rid of you after 22 days sickness then I'm definately a goner :nervous

22 days doesn't seem a lot, a colleague in my office got sacked this year, must have been about her 3rd stage 3 :shock: and her absenses were horrific.

22 days in 3 years - this is where the system fails the individual. If you take lots of 1 or 2 days sickness then although you show a willingness to get back to work as soon as you can, you still fall foul of the managers who enforce the rules rigidly, instead of treating each case individually.

Just for info here is the current process for Stage warnings:

Stage 1: 4 absences or 14 days in a 12 month period
Stage 2: 2 absences or 10 days in any 6 month period during the next 12 months
Stage 3: 2 absences or 10 days in any 6 month period during the next 12 months

u used to they changed it you just go back 1 now
