My partner has just been forwarded a letter from the CWUs Legal Department with regards to his unfair dismissal claim.
Although they say he has a case as he was not informed that the AOD that lead to his sacking would be counted they say as he was largely to blame for the AOD it may not be worth taking his case to an ET. Royal Mail say my partner was largely to blame as a means of dispensing with his services. My partner both in his Stage 3 and Appeal interview has categorically denied that he was blameworthy so can someone tell me when exactly did the CWU Legal Department start taking the lies of Royal Mail managers whos sole role is to dismiss as many fulltime posties as possible over the word of one of their members.

Well TBH it isn't going to be a question of who is going to be believed it is a question of whether there is a chance of winning and like all legal eagles they will not take a case that is not, in their opinion, winnable. I assume that your partner was represented at his stage 3 and appeal and a good rep would have warned him that taking the case to an ET was most unlikely. The sad story is that few get to ET and of those who do there isn't a strong likelihood of winning. There have been cases where an individual has presented his case and won, though that is as rare as rocking horse manure.

I would go and see an employment lawyer, they will give you 30 minutes free consultation, they will tell you whether you have a case or not and whether it is worth taking it to a employment tribunal. Always seek legal advice from a employment lawyer because there as been many cases where members have been given misrepresenting advice and they have gone onto a ET and won. The employer lawyer and ET might find that the AOD was not his fault and might be able to find loopholes in the case.

If there is any error in procedure during his dismissal he has a case to argue,have learn't alot about ET'S over the last year.I would seek further advice, but simpson & miller are very helpful. :hmmmm
