I and the other person who covers Callers have been asked if we would go back on to deliverys. We are both going to say 'no' as we would go back as reserves as some of the office has just had a repick. The reason we are being asked is because staff that were on nights can't do a delivery apparently. My question is Can we get taken off our (we signed into them) duties to accomodate more senior night staff? I've been in Callers 3 years and my colleague 5 years and obviously we had a different selection process, suitability rather than seniority. We feel at the moment the time is'nt right to go back onto deliverys and don't want to be forced back.

Yes you can technically. Reckon though if your DOM wanted you he could defend your corner!

why do you think the time isnt right?

why cant they do delivery? is it dda? or supported by atos advise

I would say they still have to be suitable for callers officer role. The term "signed for a role" is not relevant in law, its only your contract thats worth anything

The time not being right as stated is due to the repick has already happened, if we were asked when repick took place our answer may have been different. I asked to go back on deliveries last year but that was'nt convienient for 'them' at the time. I've no idea why some of the ex-night staff can't do a delivery. So what you are saying, 'technically' anyone who is more senior than you can have you moved off your duty if they want it? That does'nt seem right.

i think we need to understand why they cant do delivery. if its disablility issues then yes a business can move you to a suitable role to accomadate their disability. seniority does not enter in to that. if it is not dda related i am sure a good dom (and a realistic cwu) should protect you and sent the senior guys on the streets

I would of asked this question also as i have a signed for walk and i hated being moved to a rural. I was told it was the needs of the business and not much could be done. :evil/mad

This was mentioned to me recenetly when we as told that a person might have to be given a walk near to the office because they were diabetic and they would have to move a senior bloke off his walk to accomodate this. The only stipultaion under DDA states that reasonable adjustments have to me made. If you move someone off there walk for this they would then claim age discrimination. Tricky One. The one reason our nights couldnt do a walk is because they a lazy B**tards :oops:

They can't claim age discrimination as senority is not dependant on age but length of service

Border i was just refereing to our Situation not in General. In this case it was the oldest bloke who had been there the longest. Cant loose can he :Very Happy

16.4 Where there is a major change as defined above, the key principles for dealing with the re-sign are:

• Employees whose jobs remain unaffected by the major change will retain them;
• These employees will have the option of applying for any of the jobs involved in the re-sign resulting from the major change, provided they have completed a minimum of twelve months on their existing duty (see Section 14 and 15). If this creates a resultant vacancy that would be filled using the normal resourcing procedures in Section 14 or 15;
• Employees taking part in the re-sign will be given the opportunity to advise of any personal circumstances, which necessitate a particular duty type or attendance pattern and, where practical, this will be accommodated. Where this happens, there will be prior discussion with the local CWU rep;
• The re-sign and all consequential training must be planned into the revision process;
• Specialist jobs that are reselected against are filled using the procedure in Section 15;
• The re-sign will be run using a national standard procedure based on seniority, and not take more than four weeks to complete. In very large units, agreement to an extension to this deadline must be given by the Head if Performance following local discussion between management and CWU. At the end of the exercise all jobs and reserve posts must have been signed for.

Before the repick took place there should have been a preference exercise which stipulated which duties would or would not be included. This would include DDA and those with child care commitments. This is a very thorny issue and really needs addressing at the highest level. For me it is the thin end of the wedge for those who are senior and get moved to accommodate someone with less seniority. I would not dispute the fact that there are reasons for people requiring special treatment BUT that is for RM to make arrangements and not for individuals to be moved from their existing duties. If necessary new duties would have to be created to accommodate them.

Had the DOM ask me this morning about going back on deliverys, don't DOM's & LM's communicate with each other, he did'nt realise I'd already been asked. I said again I would'nt go out on delivery as the repick had already taken place and I don't want to be a reserve with a different duty each day. He made a point of telling me that if one of us don't come out of Callers they would have to let the ex-nights bloke go. BTW the guy has a bad knee.
If they make me an offer I can't refuse I may reconsider.
