To give a little background to the story:

I was involved in an accident at work that resulted in me being off for a period of time on sick leave. At a meeting with my manager later on I suggested returning to work early (as I was not eligible for full sick pay) and this was agreed with my manager even though I was still sore from my injury. Since returning to work I have suggested changing my hours to make better use of my time, this was accepted.

My manager wants me to return to deliveries even though I have been seen by the works doctor, the works physio and my own doctor who have said I should avoid lifting and carrying heavy weight for long periods of time. Since I’m on deliveries I still cant do this and subsequently I have been told by my manager that my contract will be terminated. (i'm not on any stage warnings etc)

Is this allowed considering I have a line covering me from the royal mail doctor, voluntarily changed my hours to make better use of me etc…

Cant understand why you cannot get full sick pay?
Because it was an accident at work and is in the accident book, that manager should be not be threatening to terminate anything except his own breath!!
Because you have said you will return to work but really you should'nt be, and getting sick pay, he should bend over backwards to find you rehab work.
grievance time my friend get your rep onto it!!!

i'm under the impression that i dont qualify for full pay as i've not been in the job long enough (6months) im part time also...

i've also been back at work for 2 months.

the thing is though, can i be sacked because in their words "i'm not fit for my duties"?

No mate you had an accident at work----they should be giving you rehab work!!

Would urgently suggest that you get both your IR Rep and Health and Safety Rep involved plus I cannot see any harm in you notifying the CWU Health and Safety Department at CWU H.Q. and make them aware on just what is going on and what has been said by your manager.

Surely there is a procedure for Ill heath retirement when the ill health was caused by an accident/incident whilst on duty. I am fairly sure they cannot just terminate your contract without some form of procedure or settlement.

Any H&S reps got more information.

i thik i will get in contact with the cwu and other bodies. i forgot to mention that i have been offered alternative employment at a mail centre but with a change in hours that is not suitable.

Can you be fobbed off by them saying thry have offered you alternative employment with the company even though it is not what you signed up for or is even suiting you?
