I followed his proceedure and videoed myself returning mail to a locked Doff at one oclock
I told my dom on many ocassions that i was not pouching off,taking mail to post office ,returning it to them on MY time as they would often discourage us from claiming ot to protect our office budget etc etc..
Back then i was caught in a catch 22 situation, as i would come to the do in the morning and carry out various duties ,kill offs, d2d prep etc i would be left with under three hours to complete a full time round without ot , which is of course not compulsory i told my dom i didnt want the ot any more just the 4 hours a day after six months of them getting freebies out of me.YOU GET WHATS YOU PAY FOR
Any way ,I KNOW I KNOW THIS IS WRONG, i started to take mail back to my house and take it back the next day at work cos the Doff was closed and i certainly was not going to take it to a post office on my time, i was never informed about the cutting off proceedure etc (i was a newbie)
Anyway this is how i did it for months , even during the strikes but late last year the Rm IB arrested me at work and searched my car and found mail that i was returning they searched my home and found some old excess D2D items that were from another office where i had done ot previously.
I told them i was only following a work proceedure as laid out by a dom ( i have dom on video telling me i cant claim ot ,and to return undelivered mail etc) he dont know this.
Late last year i quit as the RM suspended me for wilful delay , they also accused me of theft (CHARGES DROPPED), what the RM dont know is that i have them on video advising me,what i now know is incorrect,to carry out what they asked of me.
soon i am in court and will be pleading NOT guilty to charges of wilful delay and thier claims the , remeber these were excess from various contracts, the RM is also alledeging that i delayed items of post that was dead mail and endorsed not by me but by a guy who prepped my walk and left his dead mail in the fitting , i picked this up by mistake.
The RMS IB came into my work place and arrested me . I offered them a full explanation (not the vids though) but they did not accept.
what they dont know is im about to pull a huge rabbit out of the hat, in i started tribunal proceedings against the Rm for breach of contract, incorrect training, discrinination against a part time employee and constructive dismissal.
I was in the cwu but had no time to consult any reps about legal issues and now i quit the job under extreme pressure from the RM .Its complex but any one got any advice?...phew

No i supported the strikes as i was on a small contract, they tried it on with me by trying to send me out with three days worth of mail when i came into work...it didnt wash with me i continued to tell them i would only do the hours i was being paid to do .POSTMAN wrote:But did you work through the stikes?
Six months previously they employed five newbies in my own office but on higher hours yet we were all classed with the same job discription hence my claims for discrimination...., one of the reasons for my own work to rule in the first place they were obsessed where i was located with saving money..they tried to harras and bully us part timers ..thats why i videoed em..you ought to see em one slimey dom giving me some serious BS ,telling me i wouldnt be paid for excess hours etc...its as clear as a bell cant wait to see him squirm at the tribunal hearing shortly.

I played them at thier own rules and they didnt like it it seems.
I guess they thought i was some chav when i was talking to em about contracts/overtime etc with a mobile phone swinging on a band around my neck..what they dont know was video was set to RECORD so i kinda asked the questions and they gave me the answers whos the dummy now eh?:chuckle

Not according to my solicitor he tells me its admissable think about it the police use cctv for court cases do they not?.im sure a burglar caught on tape has no idea hes being filmed either....dogfood wrote:I thought that videos and taped conversations that are recorded when one of the participants is unaware that a recording is being made, is not admissible in a court case.

The same applies to people who have cameras outside their houses that unless they are registered with the DPA then those videos cannot be used against you.

Trust me mate all avenues have been explored by myself , also some of the video evidence i have is of me and me only carrying out proceedures that i have been told to do ...
