No,I think not ,I’m guessing you have triggered a stage warning throughout recent absences?

Not me personally but yeah stage was issued and quashed on appeal..but manager now saying its excessive an next sick under equality act may well count.know people who have taken alot longer absences under equality act an not been given stages so just wondering is it starting to become a personal thing.also line in the sand letter issued.although from what ive read on here not worth the paper they are written on.

Re: Equality act.
The Stage absence procedure is a total wind up and if covered by the Equality Act then a Tribunal would walk all over it.

Re: Equality act.
in my experience of being both a person who was deemed as being covered by the Equality Act at a tribunal, and as a former Rep that most of the managers do make things personal, in alot of cases they are told to issue stage warnings as a matter of course, this is down to senior management telling their underlings that they MUST issue stages ` as it will get thrown out at the reason to urge stage` which as many people have unfortunately found out to be a right load of old bollocks.Sean06 wrote: ↑21 Dec 2023, 08:44Not me personally but yeah stage was issued and quashed on appeal..but manager now saying its excessive an next sick under equality act may well count.know people who have taken alot longer absences under equality act an not been given stages so just wondering is it starting to become a personal thing.also line in the sand letter issued.although from what ive read on here not worth the paper they are written on.
Royal Mail managers.....about as popular as a t.urd in a swimming pool!
The DDA/Equality Act demands action,NOT words......adjustments NOT Occupational Health referrals.Case No:2505901/09
Royal Mail is an Equal Opportunities Employer..It discriminates against everybody.

I’m currently on sick atm but when I’m returning to work il be up for a stage 3 I have been on medication for well over 12 months for the sickness I’m suffering would that be covered by the equality act? Is there much point in going back? Or should I quit now? Any advice appreciated chaps

Have you had any recent assessments by occupational health?theelegend701 wrote: ↑08 Jan 2024, 17:21I’m currently on sick atm but when I’m returning to work il be up for a stage 3 I have been on medication for well over 12 months for the sickness I’m suffering would that be covered by the equality act? A manager with half a brain should be looking to do this to cover their own arse.
Contrary to popular belief the point is not simply to prove your illness and absence is genuine or covered by the equality act (or not)
But to assist in finding reasonable adjustments and providing support that would enable you to continue to to attend and do your work in a meaningful way.
I'm saying this because, people hear 'Equality act' and often just think 'as much time off as you can get away with' or 'piece of pish duty' 'unsackable' and whole there may be some leeway in those things they are not an absolute truth
if you have disclosed a disability and your manager hasn't made any efforts to gain advice and/or provide reasonable support and accommodations to make work as accessible as possible to you and then trust to punish you for not being able to attend due to barriers that can be removed, then you absolutely have a case to fight.
Appreciate that this may all be irrelevant as I don't have much information to go on. But might be useful to someone.

Re: Equality act.
Do not quit ! Before returning back to work get an OH assessment who will advised RM how to support you back at work.Doing this will help provide evidence that you have a genuine ailment and make it very difficult to sack you at your stage 3 interview.theelegend701 wrote: ↑08 Jan 2024, 17:21I’m currently on sick atm but when I’m returning to work il be up for a stage 3 I have been on medication for well over 12 months for the sickness I’m suffering would that be covered by the equality act? Re: Equality act.
If an employee has a mental health issue and is just over 3 months less 1 day the judge has the ability to extend this period. If you have a good union rep with knowledge, this is an easy process.

Re: Equality act.
At the prelim hearing the judge will decide whether part or all of your claim can go ahead.
This may include a ruling on whether it was submitted within time.
