LTB 488/22 Ballot expiry dates and new ballots :
LTB 488/22 - ROYAL MAIL GROUP DISPUTES – RE-BALLOT TIMETABLE
No. 488/22
9th December 2022
TO: ALL POSTAL BRANCHES
Dear Colleagues
ROYAL MAIL GROUP DISPUTES – RE-BALLOT TIMETABLE
Branches and Representatives will be aware the programme of strike action held throughout November, was once again overwhelmingly supported by CWU members across Royal Mail Group. Twelve days of strike action relating to the two disputes have now taken place with further action and a national rally being held today, as well as further strikes in the lead up to Christmas.
As a consequence of the Tory Anti-Trade Union laws, there is now a legal requirement to conduct a re-ballot of our members after six months.
As previously advised, the six-month period ends on 19th January 2023 for pay and on 17th February 2023 for change.
As the focus of the disputes has now shifted to a combined set of negotiations, it is prudent to ensure a re-ballot reflects this via a single ballot to encompass both of the previous pay and change disputes. In addition, given the aggressive attitude from Royal Mail Group including the very real possibility for Compulsory Redundancies coupled with the attack on the MTSF terms, the grounds for the ballot must include job security.
The Postal Executive unanimously agreed the following re-ballot timetable after consultation with the SDGS Department:
• Serve notice – Monday 16th January 2023
• Ballot papers despatched – Monday 23rd January 2023
• Ballot closes – Monday 13th February 2023
This timetable will be announced at the national rally in Parliament Square today.
Once a ‘Yes’ vote is returned the first day of strike action could potentially commence on Monday 27th February 2023. Branches should also be aware this does not prevent strike action being taken on change up until 17th February.
The SDGS Department will be contacting Branches imminently to commence preparation for the re-ballot and Branches are requested to treat this matter as a priority.
It cannot be stated enough the current disputes do not end at Christmas and there is still pressure to be exerted in the New Year in the event that Royal Mail Group do not see sense and enter meaningful negotiations.
Branches and Representatives must therefore be sure membership engagement continues to reinforce the message that it is vital another massive ‘Yes’ vote is returned. Discussions have commenced with the Communications Department concerning the re-ballot and the New Year will see the campaign gather momentum, including a National Briefing (date to be advised).
Any enquiries on the above should be addressed to the General Secretary/Acting Deputy General Secretary (Postal) at jdunn@cwu.org/hford@cwu.org.
Yours sincerely

Re: LTB 488/22 Ballot expiry dates and new ballots :
Yep just in time so the postal backlog will be cleared and this dispute is not about backlogs but a change in attitudes of the employer we will keep on fighting forever. Even if we get over the line another hurdle will be placed before us and it is an ongoing struggle for our rights not just as postal workers but as citizens of the nation and the world!Acca Dacca wrote: ↑09 Dec 2022, 14:55And the current change ballot can be used to strike until 17th Feb

Ballots last six months, that is true,
But what about the 12 weeks deadline that expires on the 23 December before a new ballot is needed to continue direct strike action as ACAS have been involved in the dispute?
Yet again silence on this important update with the members

Re: LTB 488/22 Ballot expiry dates and new ballots :
Now where in the mediation process with ACAS does it state Binding Arbitration is a condition of a reballot under the TULRCA 1992?
ACAS has no statutory powes to impose such terms
Now are the CWU going to answer the question members really want an answer as we are talking a two week deadline rather than playing Russian Roulette with their jobs?

Re: LTB 488/22 Ballot expiry dates and new ballots :
The Ballot process under current legislation expires after six months in which a new ballot is needed to continue any action, that is not in dispute. However?
For the legal protections continuing once ACAS have been involved requires a fresh ballot after 12 weeks for direct strike action against the employer, as in a walk out.
If an employee walks out with or without instructions from their trade union without those statutory 12 week protections, they will be in breach of their contract of employment and subject to disciplinary measures.

Just posted you a link read it because we are right and you don't know what your doing causing a stir on here is tantamount to treason in our book. The whole process was talks with mediation like marriage guidance it is a facilitator of reconciliation and a meeting of minds that is ACAS none of which precludes or stops us from the protest of withdrawing our labour. Nor indeed will it result in mass sackings or redundancies of staff as to your stance we are playing russian roulette is nonsense we all had a vote is laughable at best.redlen wrote: ↑09 Dec 2022, 16:48Now where in the mediation process with ACAS does it state Binding Arbitration is a condition of a reballot under the TULRCA 1992?
