This ^^^ is not doubted, it's the law. But IMHO even if a ballot had been held before 23rd Dec (hypothetically) or with the new ballot
to be held Jan/Feb 23 I don't believe the clock for the protection from dismissal will be re-started with a new vote for
strike action - because it's a continuation of existing IA.

If there's something written down that says the protection will be reinstated every time there's a new ballot I'd be interested
to see it, as unions would make it a standard practice to revote every 12 weeks after ACAS/attempts at resolution are made.

Sorry to say it but after 23rd Dec in theory the protections probably won't be there if tested in an ET but I don't think RM
are that stupid to arbitrarily start dismissing people before Christmas.

Without doubt though the laws/regulations are not 'worker' friendly!

As previosuly stated, Royal Mail are not going to dismiss before Christmas, even if the intention is there.

Disciplinary process takes months and you have to tick all the boxes in avoiding an ET. Even with dismissal you will probably be made to work your three month notice period.

Dear Colleagues
ROYAL MAIL GROUP DISPUTES – RE-BALLOT TIMETABLE

Branches and Representatives will be aware the programme of strike action held throughout November, was once again overwhelmingly supported by CWU members across Royal Mail Group. Twelve days of strike action relating to the two disputes have now taken place with further action and a national rally being held today, as well as further strikes in the lead up to Christmas.
As a consequence of the Tory Anti-Trade Union laws, there is now a legal requirement to conduct a re-ballot of our members after six months.

As previously advised, the six-month period ends on 19th January 2023 for pay and on 17th February 2023 for change.

As the focus of the disputes has now shifted to a combined set of negotiations, it is prudent to ensure a re-ballot reflects this via a single ballot to encompass both of the previous pay and change disputes. In addition, given the aggressive attitude from Royal Mail Group including the very real possibility for Compulsory Redundancies coupled with the attack on the MTSF terms, the grounds for the ballot must include job security.

The Postal Executive unanimously agreed the following re-ballot timetable after consultation with the SDGS Department:
• Serve notice – Monday 16th January 2023
• Ballot papers despatched – Monday 23rd January 2023
• Ballot closes – Monday 13th February 2023

This timetable will be announced at the national rally in Parliament Square today.
Once a ‘Yes’ vote is returned the first day of strike action could potentially commence on Monday 27th February 2023. Branches should also be aware this does not prevent strike action being taken on change up until 17th February.
The SDGS Department will be contacting Branches imminently to commence preparation for the re-ballot and Branches are requested to treat this matter as a priority.

It cannot be stated enough the current disputes do not end at Christmas and there is still pressure to be exerted in the New Year in the event that Royal Mail Group do not see sense and enter meaningful negotiations.
Branches and Representatives must therefore be sure membership engagement continues to reinforce the message that it is vital another massive ‘Yes’ vote is returned. Discussions have commenced with the Communications Department concerning the re-ballot and the New Year will see the campaign gather momentum, including a National Briefing (date to be advised).

Look guys. Just get them to give everyone who wanted VR, the deal that they agreed would be agreeable with then in the preference exercise. Be it 5, 10 or 15,000 people. Just let everyone go who wants to, then see how many are left. I bet compulsory redundancy will not be needed. Get a cast iron solid start time/finish time (no agree to complete nonsense) into any deal. Get a realistic no strings 6-7% backdated rise. Concede that start/ finish times will have to be later. Sunday working for those who want it, but has to be at enhanced rate if it's not compulsory. Not sure how to tackle sick pay. Those genuinely sick will be more inclined to take a couple of extra days if they were ready to go back after 3 or 4 days I'm sure, under their proposal. It's hard to weed out the fraudsters.
All of this, I would accept. If you have a finish time, it's not going to matter how short staffed or how big the walks are, you won't be doing any more work than you already do, that's why that would be a must have. But please don't try and protect the jobs of all those who would like to go with a £handshake.

Backlog, what backlog? I had a mobile SIM card come in 2 days, just ordinary 1st class, not tracked. Office not as busy as normal early December. I'd say between those working overtime and days off and the agency, the strikes have made bugger all difference.

With respect welcome to world non RM workers have to put up with.

One day the Pendulum will swing back in our favour until then buckle up everyone.

The thinking of many on here/menbership/PEC is still pre Nationalisation. That world has gone and people need to realise that… and quick.

Wouldn't say it's a bunch of laughs. A lot are working tons of overtime and days off. Lots of agency doing pkts. A lot of walks being cleared every other day, one half one day, other the next. Not much backlog though.
