You would have thought that union negotiators would have had legal advice for this. All they needed to do was google it. Who knew?

I was lead to believe the start/finish times are NOT part of your obligated contract....i.e. if you are on a 40 hour contract then RM have every right to change the start and finsh times if they wish, but cant alter your 40 hour contract...so the could make you start 2 til 10 in theory Thursday til Monday and you can do nowt about it, as you are STILL getting your contracted 40 hours...i am a 100% certain i will be corrected if thats not the case.

The seasonal variation has much more chance of being successfully contested given they want the long hours from us before the short and are introducing it halfway through the financial year ( which is how our leave is calculated )

And also given that some offices, including my own, insist that you take three of your annual leave weeks during the period we would be working shorter hours so while you will use less hours of your annual leave, it isn’t balancing out on hours worked given you most likely won’t be off for three weeks in the autumn period

Likely to be 13 long weeks and only 11 short ( based on basic 4 week holiday entitlement of 4 weeks and being told to take 3 weeks summer 1 week winter )
If you tolerate this, then your paid break will be next

This isn't the first time they've changed our hours. Used to start at 5am and now we don't. It's been done before without the CWU putting up a fight so they'll do it again.

Yeah I don’t know how the new contracts are worded but if you’ve been doing the same hours for a long period of time it can be argued that that is your contract with regards to working hours....
Yes, mine has the wording about business needs and changes but nothing specific. I'm on a 24 hour contract but by now really should have been made up to my usual 39 hours.

It's not just new contracts, very few contracts will have an exact start and finish time because these contracts are standard across the business and different offices start and finish at different times already..

The only people who may have a legal solution are those under agreed flexible working/family friendly.

All the people in our office are having them taken away ,you couldn't make it up they are taking them away before the vote is even in.

Ask for a copy of your contract
They will not have one you have personally signed up to
Is this legal

If the result of the ballot is a no then we do have rights

By law we can refuse to work the new start/finish times should Royal Mail attempt to impose them without agreement

I have sent the information that I’m sharing with you below to my area union representative and he is discussing it with the unions solicitor on Monday so we can fully understand the implementations and risks involved with this course of action

Let’s make an informed decision based on the facts

This will have a much bigger impact if done nationally rather than locally so I’m asking that you could do the same and ask your union reps to contact the unions legal advisers regarding this so we can fully explore this option and look towards our next steps should the ballot return a no vote

Please don’t leave it to someone else, you are someone else!!!

Have the cwu lawyers not already gone through this surely.hope not a google post :Very Happy
Hi there just a though. I myself and loads more work in a large mail centre and had start / end times changes.
Also been taken off Monday Friday to fixed Tuesday Saturday. But with the union signing them off. So does that employment law not stand because most were bullied and pushed into taking the changes because management were threatening you will lose your job

IIRC pretty much every Royal Mail contract is worded the same, which gives your working hours as between X and X - I think mine states between 7am and 10pm.

So legally speaking you haven't got a leg to stand on to contest later start times, unless you're one of the lucky few with a family friendly contract that outright states a specific start and end time.

You've already agreed that your working hours can be later, this is just Royal Mail actually implementing it - the only reason it's something they negotiated instead of imposed was to avoid strike action.

If the deal fails they will implement it anyway and then dare the CWU to go on strike to stop it.

Actually, on my it doesn't even say between X and x. Probably on the website that I signed on intially but on my actual contract it says the amount of hours my contract is and that it might changes from time to time as long as there is notice given. Completely agree with you on them having the means on enforcing it without push back!

I haven't voted either way, as my ballot is in one of the 15 crates of unsorted IPS next to what was once an absorption route and is now just sat there as none of the "bolt-on"s for it were actioned, and the few poor souls that have to cover it twice a week can't keep up

If RM actually cares what the outcome of the ballot is, wait till you see anecdotes like this cited as reasons to bring the validity of the ballot into dispute.
The machine stops.
