LTB 181/2017 HOLIDAY ENTITLEMENTS - PARTIME AND FULL TIME STAFF MAKING FEWER THAN FOUR WEEKLY ATTANDANCES

30th March 2017

Dear Colleagues

HOLIDAY ENTITLEMENTS - PART TIME AND FULL TIME STAFF MAKING FEWER THAN FOUR WEEKLY ATTENDANCES

Branches and representatives will be aware that full time OPG’s are currently entitled to 8 Bank Holiday credits per annum. For OPG’s who make less than four attendances per week this is adjusted using the following equation:

Days of attendance ÷ Days of week x 8 (Bank Holidays)

Therefore for example, a colleague who makes three attendances per week would be entitled to:

3 ÷ 5 x 8 = 4.8 (rounded up to 5)

This would mean that for the remaining 3 Bank Holidays an individual would not have any entitlement remaining and would be expected to attend on a Bank Holiday or make up any hours owed. This arrangement was introduced as part of the 1995 National agreement Harmonisation of Part Time Conditions of Service as it predominately affects Part Time Staff, but applies equally to full time staff (including notional Full Time Weekend duties) making fewer than four weekly attendances.

Over recent years it has become increasingly apparent from enquiries received at HQ in relation to Christmas Arrangements that many colleagues are exhausting their Bank Holiday entitlements prior to the festive period. Clearly given the family connotations involved with the festive period, the wish of many of our members is to spend time with their families at this time and not having any Bank Holiday credits remaining can undoubtedly impact on that desire and lead to disappointment.

As very few enquiries are received by Headquarters in relation to this issue outside of the Christmas/New Year period we would ask Branches and representatives to ensure that our affected members are reminded that, within the agreed arrangements they can nominate which Bank Holidays they would like their credits applied to.

As such they should inform their managers at the start of the leave year of their choice of selected Bank Holidays. We believe that this would resolve some of the issues being experienced and assist in enabling our members’ aspirations in relation to spending time with their families over the festive period.

Where a selection is not made normal practice is to apply the credits as the Bank Holidays occur throughout the year.

Ultimately of course the decision of when to apply their Bank Holiday credits would be a matter of individual choice for the member concerned.

Branches and representatives are requested to ensure that our members are made aware of the contents of this LTB at the earliest opportunity and we thank you in anticipation of your assistance in this regard.

LTB 181/2017 HOLIDAY ENTITLEMENTS - PARTIME AND FULL TIME STAFF MAKING FEWER THAN FOUR WEEKLY ATTANDANCES

Four of the normal eight bank holidays are on Mondays for depots in England.
Good Friday bank hol is on Friday, funnily enough.
Which leaves the Xmas and New Year bank hols as ones that roll forward by a day each year (two in a leap year).

Is the PSP system correctly ensuring the 3-day and 4-day PT staff get 5/6 bank holiday days off (or annual leave credits), according to their rota, which varies from one depot to another?

For example, many (but not all) 3-day PT staff at my depot work a set pattern of Mon/Tues/Sat each week (so they are only guaranteed to get four bank hols off of their 5 quota), depending upon what days Xmas and New Year fall on. In 2019-20, for example, they have four that fall on their shifts (so they should get a credit, or claim "b/h excess" overtime)?
