Hi all, can someone enlighten me as to why i have received nothing in my pay this week from the holiday pay?
I have performed unforeseen overtime for the last two years totalling about 9 hours per week
the only month i didnt do anything was September 2021 due to getting pension and therefore not needing to do o/t anymore
So i only missed one month so from the criteria i miss a six month chunk but the other months surely i qualify??
Have also messaged on the my people app..hoping an expert here can help??

contrary to how the union dangled the 'backpay carrot', you have have worked a minimum of 8 hours EVERY month in the 6 month qualifying period.
if you go less than 8 hours in ONE of those months you don't get any back pay at all.
consider the following:
if you worked -
100 hours in january
100 hours in february
100 hours in march
7 hours in april
100 hours in may
100 hours in june
you get NOTHING because you missed an hour in April.
It's scandalous because that hour could have come from your manager forgetting to put it on, having a quiet week etc.

I’m in the same boat. Outrageous and probably illegal. I will write to the boss and tell him what I think. That’ll scare him….

The only thing that will scare RM is if everyone who’s missed out puts in an employment tribunal claim. RM will be banking on most of those who missed out to complain then ultimately do nothing about it. If even 75% of those put in a claim that’s a lot of solicitors fees, a lot of time and money and shows that this issue hasn’t gone away.
The day is gonna come when we’re all gonna have to testify.

It's proper daft.I could do 10 times more average OT then anyone but because I was on annual leave or sick I miss out, even though it's generally considered a legal requirement I'm paid those average hours.
The union have fooked this right up,can't even say well you voted for it because it was branch not individuals.

Actually, that's not a bad idea if we ALL write in disgust to him AND the union for it was they who passed this deal knowing full well what the outcome would be.

It’s exactly these cases which show how unreasonable the deal is. If everyone who gets nothing because of this 8hr x 6 agreement (which was only ever going to benefit RM as is now more obvious) puts in a claim to the Tribunal now, the whole debate gets opened up. The last says that employees are supposed to be paid their average pay across the last 12 months when on holiday. In companies where employees work overtime once a quarter, there is an argument to be had over whether that is sufficient to count as regular. However, posties work overtime pretty much all the time unless sick or on leave. That is regular in anyone’s definition and so should be the basis for payment, not an artificially set 8hrs a month in every month in a set 6 month period.
Agency posties get their average holiday pay without having to meet any 8hr criteria. How can it possibly be seen as fair that permanent posties get paid less than agency posties when on holiday? It can’t so get those claims in and see what a Tribunal judge decides. Nothing to lose, as you get the Union deal going forward anyway as that is agreed.
