Letter from Angard - AWR

Post by Verging »

Received a letter today with respect to AWR.
The Implementation of the Agency Worker Regulation ensures equal treatment in respect of basic terms and conditions for agency workers compared to those of directly employed individuals after 12 weeks.

Angard Staffing are fully committed to this legislation and as a result are making adjustment to pay for those indivduals reaching 12 weeks.

You have been identified as having reached or approaching the 12 week qualifying period.

For those employees reaching the qualifying period adjustments to pay will be processed accordingly, typically resulting in an enhanced rate of pay.

If you are one of the individuals qualifying we will contact you directly to discuss your present engagement and to ensure full understanding of your entitlement to all the appropriate elements of pay.
It continues but does not mention other benefits at all and says to phone the usual 0845 telephone line if you have questions.

Called them to say I believe I qualified on the 24 December 2011 as I had worked for the Hirer (Royal Mail) continually since 1st October but was transferred to Angard in November and would I receive back pay. Indication is they will not include the weeks since 1st October until I was actually working for Angard as part of my 12 week calculation - "as direct employment is excluded from benefits of AWR". So looks like I will lose out because RM did not transfer me to Angard before 1st October. Not sure of the legal situation as the 12 week rule is working 12 weeks with the Hirer and not the agency (can be multiple agencies). Think they have a very strict interpretation of the qualifying period as they seem to be saying you must have worked the 12 weeks for Angard or an Agency and any weeks direct with RM are excluded.

Now awaiting telephone call to clarify this and to put my point across.

Letter posted 2nd class from London on 31st January and arrived today

The letter itself was not dated and nobody actually signed it - just signed Angard Staffing.

So if i have read the letter right and you qualify, does that mean if you work next to me on say an 8 hr shift, you will get the same hourly rate as me and have paid breaks like me?

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

In principle it should do but lets wait and see what they tell me when they contact me direct. Do you get "extras" for anything e.g. length of service, any training enhancement, driving, machine operation etc. We probably will not get any "extras" unless we qualify for them accordingly.

Well I take it you have been in the job for a while so I would take it that the hourly rate would be based on a new starter on a RM contract. There must be a benchmark for that? Shift allowances etc would also be paid at whatever the going rate is.

Not sure how long this will all last as I have read that RM are looking into taking people on "Workfare" (freebies!! even cheaper than AnGREED casuals) :left:

Work Programme is nothing new, it's the Tories version of Labour's flexible New Deal. Its a pure workfare programme in that the "clients" as they are now called, get nothing more than they do on benefits.

I spoke with Angard and they confirmed pay will be the same as a full time person who is employed by Royal Mail. So wait a little time and you should get more money.. :Very Happy

Been extremely interested in this as tomorrow will be the end of my 9th week. So if I remain working for the next 3 weeks then I am entitled to a better rate of pay and other conditions. Does anyone know what sort of rate this would be? Rumours I have heard is £9.50 p/h is that near the benchmark?

I've been with them since the start of November and received one of the letters yesterday. Last week I did 40 hours and today I received £319.68 after tax/ni.

What it works out at exactly I don't know without one of the mystical payslips but its definitely over the £8 an hour mark

its £8.90, I've been getting it since Christmas Eve. Which isn't the same as the perma staff get, but we were told by the supposed Union rep where we work, it was the agreed rate.
