So will everyone this christmas be put on BR tax code? due to Angard not sorting out peoples p45 and p46? they have not told anyone on where to send there p45 or a p46 no mention of it at all.

Hi

My payslip last week quoted OT week 1/month basis.

Which basically means zero free pay meaning that you pay tax at 20% on total gross pay.

0T should only be used by an employer when they (the employer) has not received a P45 or P46 from the employee or the HMRC has instructed the employer to use 0T.

Week 1/Month 1 means that each week's tax/pay is treated separately and ignores what has happened in previous weeks.

Employer is supposed to issue a P46 to every employee who does not give them a P45.

Incidentally I downloaded a P46 from the HMRC website, completed this and posted it to the Angard Office in Northampton (as directed by them over the telephone).

As no-one from Angard or the RMG bothered to issue a P46 to any of my colleagues at the centre where I worked, i printed out 25 copies of the P46 from the HMRC website and my colleagues completed these and handed them to the RMG management.

Despite our collective efforts to ensure our tax was calculated correctly, when everyone received their first payslips, Angard had achieved 100% consistency, everyone was incorrectly taxed on code 0T Week 1/Month 1, meaning almost everybody had overpaid tax.

Angard should have operated emergency tax code (745 L Week 1/ Month1) for most people completing a P46 or code BR for anyone who receives their Free Pay Allowance somewhere else (ie Pension payment).

Even if Angard get round to eventually processing the P46s, people should pay less tax each week,but will not get a refund of previously overpaid tax until HMRC issues a cumulative tax code. This typically takes 4-6 weeks, so most will have ended their employment with Angard before this happens, so guess who loses again - not Angard.

Whilst this is not good news I hope it helps you understand things better and see how things should be done rather than how they are being done.

hi,
so does that mean anyone who has not submitted a p45/46 to angard before there 1st pay date will be put on emergency tax?as phoned payroll today had great difficulty getting to speak to anyone was told by a lady on option 4 that someone would ring me back today but never happened so i phoned the xmas team tonight who told me no 1 in accounts was available till tomaz an that they would ring me in morning and they gave me a email address to send them a email to just to get someone to contact me what a 1st class joke anyone shed any light on this please?

Based on experience so far it does not seem to matter if you submit a P45 or P46 to angard as they do not process them anyway.

Everyone at the centre where I worked was taxed on Tax Code 0T, this is NOT the emergency Tax Code (745L), but on my shift we all completed P46s as I printed them off the HMRC website (Angard and RMG failed to provide any) and got everyone to fill them in and we handed them to the RMG management, so assuming RMG did not bin them angard shoudl have received.

0T means you pay tax at 20% on every thing you earn (zero Free PAy Allowance).

Tax Code 0T should only (legitimately) be used by an employer in one of 2 circumstances:-

Instructed to use it by HMRC
New Starter does not submit a P45 or P46

But Angard seem to have developed a third of their own:-

Cannot be bothered to process P45s or P46s received.

Angard's use of 0T when they have received a P46 or P45 is in contravention of HMRC regulations and means that the individual over pays tax with zero chance of getting back until the HMRC issues a cumulative tax code to Angard, but HMRC cannot do this until Angard completes their part of the P46 (which they have never issued to the employee) and sends it to HMRC.

Typically this will take HMRC 4-6 weeks, by which time most people will have finished with Angard, so they will not get their over paid tax back until some time in the future at next job etc.

Not good news, but hopefully explains it a bit more.
