Postman fined for ‘bullying’ subordinates

A TRIAL court judge convicted a postman from Cebu City for shouting and calling his subordinates names in 2011.

Municipal Trial Court in Cities Judge Grace Fernandez found Rector Paculob, postmaster at the Cebu Capitol Post Office, guilty of unjust vexation.

“It was totally inappropriate and improper for the accused to comment on the personal life of private complainant, considering that the words were said in the presence of other people and uttered in the workplace,” said Judge Fernandez. Paculod was ordered to pay a fine of P200. (£3)

The case stemmed from the unjust vexation complaint filed by Mathusalem Aban and Marlene Baron, subordinates of Paculob, before the Office of the Ombudsman-Visayas.

In his affidavit, Aban said Paculob shouted at him and ordered him not to complain when he would order the former to do things in the office in December 2011.
Foreigner

“As far as I am concerned, you are only my pet dog and you should do what I tell you to do or else I will kick you,” Aban recalled Paculob as telling him.

Likewise, Baron said Paculob told her that she would always search for foreigners to have sex with her, “as if she is pretty.”

“No American will ever marry you because your face is ugly,” Paculob reportedly told Baron in the presence of other employees.
Vexation

Replying to the charge, Paculob said he was just exercising his duties as a supervisor over his subordinates. He said he merely reminded Baron not to talk too long to clients of their office so as not to jeopardize the service to the public.

Likewise, Paculod said he was just reminding Aban to wear proper uniform during office hours, but the latter did not heed his order.

In the judgement, Judge Fernandez said that Paculod’s utterances constitute unjust vexation.

“Holding a superior position does not entitle one to belittle and humiliate his subordinate even if the latter may have disobeyed his orders,” said Fermandez.
Likewise, the judge said that commenting on one’s private life is malicious and unjustifiable.

“These words cannot be considered as part and parcel of his authority to discipline his subordinates, as these are totally unrelated to the performance of her duties in the office,” said Fernandez.
