PicketLine Stoppage of Pay on Day Off and Annual Leave

Please the advice from HQ.

Royal Mail never fail to surprise us. If challenged then contact your area rep for assistance and we shall pursue the matter as mentioned in this email.

Don't be intimidated. Management MUST produce something in writing if they are going to threaten members. Ask your manager to do this.
In any event if anyone is instructed to leave then you should leave and then raise the matter as a grievance or via the area rep.

Dear Colleagues


We have received reports from around the country that Royal Mail
Managers are telling our members that should they attend picket lines
when they are on either Annual Leave or their Rota Day off they will
have a days pay deducted. As a consequence of this we have obtained the
following legal advice. This information should be given the widest
possible circulation to all CWU representatives.

Legal advice:

If their contract allows them to do as they please on a rostered day off
or annual leave then it is unlikely that the employer can lawfully stop
pay.

Subject to anything in the contract to the contrary, I suggest members
tell managers who threaten to deduct pay that if they do so the employee
will bring a grievance under the grievance procedure and if pay is not
restored they will pursue a tribunal claim for unlawful deduction from
wages with the support of the CWU. The same time limits apply for making
a claim for unlawful deduction as previously advised. (That being three
months less one day of the deduction)

they cant deduct you for your day off anyway cos you dont get paid for it, if you work the other 5 days at 8hrs a day thats 40hrs, your day off doesnt make it 48 hrs so theres nothing to deduct. If they deduct pay then they are actually taking away a days work you done. Annual leave im not sure about but i bet they cant do that as the statment says its a free country and if your not on RM property you can stand where you like.

No you don't get paid for your day off which makes it worse that the wan*er is taking a days pay off you. Who the fcuk do they think they are. I think when this gets taken all the way you should be paid the day they took off you with interest and compensation for the cause of any hardship and stress caused. :evil/mad

So there is no bullying and harrasment in Royal Mail according to Higson. If this isn,t harrassment them i am a dutchman. Have we got evidence of this happening, or is this as normal, snide remarks by managers to cause even further aggrevation. If we have documentary evidence this should be sent to the newspapers as soon as possible, as this time Royal Mail will have broken employment laws and should be brought to book. Who do the sh.g.rs think they are.

I'm not surprised they're tring this on. After all, the same people count Sunday as a day's sick leave if you are off work Monday and Saturday.

What a load of BS. There have been so many changes in the last few years that I should think all our contracts are obselete anyway. Shouldn't we get new ones?!

ref peterborough posties stopped pay for not meeting rm standards (that shite).one of the lads went on anual leave whilst on stoppage of pay rm had to pay him on holday no legal way they could stop it so if your on day off or annual leave ,its another load of shite that they try and scare ,bully and harrase you with treat it with a pinch of salt,these w*****s will get theirs ,i hate these people our office will never be the same and some people we wont forget or forgive they WILL PAY.

Does this mean that if we are not on a picket line that we should get backpay on our days off on previous weeks. :hmmmm
