PERSONAL ACCIDENT BENEFIT SCHEME: PABS (As a result of an accident at work) Now PICS

Post by POSTMAN »

Jane Ogden:Chairman & Chief Executive Office wrote:I have been in touch with both our HR team and Accident Management Unit. They have made me aware that this scheme should be discussed as part of the Accident Reporting process, through the relevant lone manager.

INTRODUCTION

Personal Accident Benefit Scheme (PABS) is a non-contractual, discretionary employee benefit provided by Royal Mail Group. Therefore, Royal Mail Group reserves the right to withdraw or vary the terms of the scheme at its sole discretion.
The scheme is designed to alleviate financial distress where individuals suffer a permanent physical or permanent psychiatric disability, as a result of an accident at work. Any potential pension entitlement under the scheme is therefore not legally enforceable by employees.
Benefits from the scheme are not dependent on blame, fault or liability.

PABS is administered by Group Treasury (the Administrator) in Chesterfield.

SCOPE OF COVER

PABS covers (accidental) injury that results in permanent physical disablement, psychiatric disability or death whilst at work (for definition of “at work” please see the section below) or travelling on official business.

Cover is also extended to include permanent physical or psychiatric disability arising out of an assault whilst off duty, where the assault is a direct result of an individual’s position/job in Royal Mail Group or if the assault occurs whilst the employee is attempting to prevent the theft of or damage to Royal Mail Group property.

Travel between home and the normal place of work is not covered under the scheme, regardless of the time with the exception of “emergency call out” and injuries or death resulting from terrorist activities.

In the event of a fatal accident on duty, the next of kin may be entitled to a payment of the maximum benefit. This payment will be made to the individual(s) entitled to the deceased’s pension benefits. Where the deceased was not a member of a Royal Mail Pension Scheme, the Administrator will require a copy of the Grant of Representation to determine to whom the payment should be made.

ACCIDENT REPORTING PROCESS

Individuals suffering an injury resulting from an “accident on duty” must enter the accident in the Accident on Duty Book. Any accident, however small, must be reported as soon as possible – usually on the day it occurs.
The details will be recorded and investigated using the ERICA incident reporting process.
The line manager will print out a hard copy report and file it in the ERICA folder, which replaces the accident book.
If individuals believe the injury is likely to result in permanent disability, they should inform their personnel unit and/or union representative that they may be entitled to make a claim under the PABS.
Serious accidents, which could result in permanent physical and/or psychiatric disability, should be registered in writing with the Administrator within six months of the date of the accident.

(NB. Notifications after the six-month deadline are returned, but we do accept some in extenuating circumstances.)

PABS administrators are part of the Group Treasury, and will only accept notifications and claims from either the individuals’ Personnel Unit or their union. Individuals must not make direct contact with the administrators of the scheme.
All correspondence between the individuals and administrators will be dealt with via the union and/or the individuals’ personnel units.

Claims for benefit under the PABS will not be considered if the accident has not been reported and recorded in the accident on duty book.

CLAIMS PROCESS

The amount payable is determined on the basis of a Department for Work and Pensions (DWP) Industrial Injuries Disablement Benefit Life assessment.
To alleviate immediate financial distress, part payments may be made on the basis of 2 years worth of DWP Industrial Injuries Benefit Provisional assessments.
No payments will be made for Final assessments.
Where a part payment has been made on Provisional assessments; refunds will not be sought if an individual is subsequently assessed for a Final period.

The DWP assessment must commence within two years of the date of the accident and an employee has three years from the date of the accident within which to make a claim. This is to support the link between the claim and the accident.

The maximum benefit payable is :-
£40,000.00 for all accidents occurring after the 1st April 2006
£31,000 for all accidents prior to this date.

Any partial permanent physical disablement will generate a payment on a sliding scale, expressed as a percentage of the maximum benefit.

For all accidents occurring on or after the 1st April 2005, payment for psychiatric disablement will be made on the basis of £100 for each percent of psychiatric disability awarded by the DWP in a Life assessment (a part payment may be made on the basis of 2 years worth of Provisional assessments as above).
*No payment will be made in respect of psychiatric disablement resulting from accidents prior to this date.

DEFINITION OF “AT WORK”

“At work” means performing activities in Royal Mail’s interest, at Royal Mail’s request, with Royal Mail’s knowledge.

Apart from the normal place of work,
This definition extends to training courses, seminars etc. connected with the job or personal development.
Outdoor development courses where an element of risk may be involved.

Travel between home and a temporary place of work (i.e. other than that normally attended).
A Royal Mail Group assignment abroad.

No. 253/17

3rd May 2017

TO : ALL POSTAL BRANCHES (EXCLUDING CHANNEL ISLANDS/IOM)

Dear Colleagues

ROYAL MAIL PERSONAL ACCIDENT BENEFIT SCHEME

This is to inform you that CWU Headquarters has been notified that Royal Mail have made significant changes to the Personal Accident Benefit Scheme. It has now been renamed as Personal Injury Compensation Scheme and the new terms and conditions greatly reduce the benefits available to our members.

I must make it clear that no discussions, or negotiations, have taken place with Royal Mail either with the Legal Services Department or the Postal Department regarding these changes.

I am currently in the process of arranging meetings with Royal Mail in order to clarify the situation.

Royal Mail have indicated that the new terms and conditions will be applicable from the 1st April 2017 and as a consequence we will put on hold all claims under the Scheme until the situation is clarified.

Further information will be provided in due course.

If you have any queries regarding the above, please contact Tony Rupa, Head of Legal Services, Communication Workers Union, 150 The Broadway, Wimbledon, London, SW19 1RX. Telephone 0208 971 7444 or via email trupa@cwu.org

Yours sincerely

PERSONAL ACCIDENT BENEFIT SCHEME: PABS (As a result of an accident at work)

Post by POSTMAN »

TrueBlueTerrier wrote:LTB 419/17 - TO ALL POSTAL BRANCHES (EXCLUDING CHANNEL ISLANDS & IOM)

Dear Colleagues

Royal Mail Group Personal Injury Compensation Scheme (PICS)

Further to LTB 253/17 published on the 3rd May 2017 regarding the above.

Branches will recall that this is a revised and re-named scheme from the former Royal Mail Personal Accident Benefit Scheme (PABS). I have now had a number of discussions and a final meeting with Royal Mail representatives and I enclose a copy of the new PICS Scheme.

Listed below are the significant changes that have been made to the Scheme which greatly reduce the benefits available to our members. Royal Mail’s attitude to the Scheme is best summarised in their introduction paragraph, which is as follows:

Subject always to the terms and conditions of the scheme, PICS are designed to compensate employees that suffer a significant permanent physical or psychiatric disability as a result of an accident at work. The scheme operates as a last resort and compensation will only be considered (subject to the terms and conditions of the scheme) when all other possible avenues of compensation have been exhausted and have been unsuccessful, including where applicable, issuing legal proceedings against a party liable for an accident. No compensation under PICS will be paid where an individual has been awarded compensation or damages for an accident from any other source.

The following is a list of changes to the Scheme:

Terms and conditions will apply to all new employee notifications received after the 1st April 2017.

No compensation will be paid where an individual has been awarded compensation or damages for an incident from any other source.

Payments will only be made if a minimum 14% assessment is obtained from the Department for Works and Pension (DWP).

Payment of £400.00 for every 1% permanent disability equal to or exceeding 14%. This applies also to provisional assessments equal to or exceeding 2 years.

No payments will be considered if the authorised sick absence linked to the accident was for less than 15 working days.

Employees must have a minimum of one year’s service at the time of the accident and still be an employee (and not under notice to terminate employment for any reason) at the time of any payment under the PICS.

Where the employee leaves the business after the provisional assessment payment has been made no further claim can be made and no life assessment payment will fall due.

No payment for death.

No payment for any injury that aggravates or exacerbates a pre-existing condition or injury, unless the industrial injury assessment issued by the DWP highlights a percentage off-set (the offset is the difference between the percentage disability relating to the pre-existing condition and the percentage disability relating to the new injury).

It is clear from the changes listed above that Royal Mail’s intentions are to totally devalue the scheme and I view their actions solely as a cost cutting exercise. Their position during our discussions set against the fact that the scheme is a non contractual discretionary employee only compensation scheme provided by Royal Mail Group and they reserve the right to withdraw or vary the terms of the scheme or cancel the scheme in its entirety in its sole and absolute discretion at any time.

Claims notified prior to the 1st April 2017

Royal Mail’s original position was that all claims that were notified prior to the 1st April 2017 would only be covered by the original terms of the scheme providing the member also received a DWP assessment and this had been received by Royal Mail prior to the 1st April 2017. In essence this meant that claims that are lodged prior to the 1st April 2017 but the member was not yet in possession of a DWP assessment these claims would be subject to the new terms and conditions.

I was able to persuade Royal Mail to take a different view and as such all claims that were notified prior to the 1st April 2017, with or without a DWP assessment, will be covered by the terms and conditions of the Personal Accident Benefit Scheme.

I notified branches in the earlier LTB that until the situation had been clarified all claims would be put on hold. These will now be processed and the appropriate terms and conditions will apply to each claims.

If you should have any queries regarding the above, please contact Tony Rupa, Head of Legal Services, Communication Workers Union, 150 The Broadway, Wimbledon, London, SW19 1RX. Telephone 0208 971 7444 or via email trupa@cwu.org

Yours sincerely
