Part Time and Bank Holidays

About 20 part timers on 16 hours work in lates on Friday saturday and monday. they have been told they have to work tuesday to make up for hours not worked on a bank holiday monday... this is from management and signed by the rep! is this right because eveyone else gets it payed.

Cant see how, if you normally work FRI,SAT & MON with contract hours, then the Monday attendance hours would be lapsed & then
shown in B/H absence - simples :roll: :roll:

If they're not actual duty holders i.e. additionals then I think they are able to move your days as long as you have a weeks notice of it.

Thanks for the replys they have had to work toniht to make up the hours and its agreed with the rep so there is nothing they can do... thanks

At the end of the day, they get a set amount of days holidays, think it's 8 BH in the year. I lose out ever BH because a Monday is my normal day off, but they need to keep a note of the holidays they have taken and take them as lieu days.

Surely if a Monday is your normal day off then the Bank Holidays would be credited to you as days in lieu, no?

Yes, but it's not the same having a bank holiday midweek.

As I said they still get the same amount of bank holidays in the year. Just have to be taken at different times.

Bank and public holidays
Where your employer gives additional days off for bank and public holidays the rights of part-timers may not always be clear. If you work under a shift system where all full-time and part-time workers are equally likely to be scheduled to work on a bank holiday then it may be enough for your employer to give all part-time workers a paid day off.

However, if you work fixed days each week, such a practice could put you at a disadvantage. For example, because most bank and public holidays fall on a Monday, those who do not work Mondays will be entitled to proportionately fewer days off. In cases like this, your employer could give all workers a pro rata entitlement of days off in lieu according to the number of hours they work. Your employer can then control when you take your holiday, coinciding with any bank holidays.

If you need further clarification about your working situation you should seek legal advice
