Strike action could be on the way in the Birmingham area over the sacking of a postman with medically diagnosed anxiety and depression.
The man, who works at the city’s Shirley Delivery Office, was dismissed in February after accumulated absences from these conditions ‘triggered’ an official company limit.
However, according to the 2010 Equality Act, absences from work caused by chronic and ongoing medically diagnosed conditions should not count towards disciplinary procedures.
His fellow workers at the unit protested immediately, but a strike was temporarily averted when the management promised the CWU that they would allow an appeal against the penalty.
But according to CWU Birmingham & District Amal Branch secretary Steve Reid, “on top of a downright wrong decision to discipline in the first place, neither the dismissal nor the appeal seem to have been conducted appropriately.”
Reports Steve has received from unit, area and divisional representatives directly representing the member indicate several “profoundly unjust and unfair” actions by the business in this case.
“I’ve been told that the manager who made the initial dismissal verdict refused to interview either the Shirley Delivery Office manager, the office unit rep, or the members’ work-partner.
“And it’s also been reported to me that, during the appeal, the appeals manager refused to meet face to face with the dismissing manager – instead, just exchanging emails.”
This morning’s Postal Executive met and formally approved the request of the Shirley Delivery Officers members for a statutory strike ballot, and this will now go ahead.
“The workforce at this unit are absolutely 100 per cent behind this member – and we held a full branch reps’ meeting this morning, with reps from all 31 Birmingham delivery units, and there is strong support and solidarity right across Birmingham and District,” Steve says.
“We demand justice.”

Hi, I have an upcoming stage one hearing, most of the sickness due to a chronic issue in my left foot / ankle, should these absences not be used against me? Cheers Jim

if you are registered under the equality act for this condition, then no it should not be issued. however if your condition does not come under this, then you can bet your boots it will be issued.

Thanks for your reply, how do you register under the equality act? you would have to go through the occupational health team, your DOM has to refer you (or you may be able to do a self referral) but if your condition has not been already registered before you were issued the stage one interview then they will more than likely issue the stage. its still worth getting in touch with them to see if they think it should come under the equality act, as this will favour you in any further absences of the same problem.

With regards to occupational health team, I asked to be referred many times when on light duties for 5 months, nothing! That explains a lot! I wonder why I never got referred ehdaveyeff wrote:you would have to go through the occupational health team, your DOM has to refer you (or you may be able to do a self referral) but if your condition has not been already registered before you were issued the stage one interview then they will more than likely issue the stage. its still worth getting in touch with them to see if they think it should come under the equality act, as this will favour you in any further absences of the same problem.

Arthritis is not automatically classed as a disability under the UK’s Equality Act 2010. However, a person will be considered disabled if their condition has lasted, or is expected to last, at least 12 months and has a serious effect on their daily activities.
