Lottery winner John Gallagher was due to be sentenced for arming himself with a claw hammer and a dog chain and attacking two men in a row over his beloved pet.

The 49-year-old had been drinking in the Clippens Inn, in Linwood, Renfrewshire - which had been his local for over 30 years - on March 20 this year.

Whilst in the pub a man called Robert Marshall began arguing with Gallagher about his prized pooch.

Tempers flared and Gallagher was accused of grabbing Marshall to the floor by the neck and trying to punch him on the body.

Gallagher left the pub following the fracas, armed himself with a claw hammer and the lead for the dog that had been ridiculed and returned to the pub, looking for revenge.

Once inside he attacked Marshall, went for him and tried to hit him with the hammer.

He also assaulted another man, Dale McPhee, by trying to strike him with the dog lead.

Gallagher, who scooped £1.2 million in a Euromillions raffle, was also accused of attacking a third man, Robert Deans, to his injury by hitting him on the head with the dog lead.

He was due to go on trial at Paisley Sheriff Court last month over the rammy but struck a deal with prosecutors minutes before his trial was due to start.

Two assault charges against him were dropped when he pleaded guilty to having an offensive weapon, a claw hammer, on him in a public place, assaulting Marshall by trying to hit him with a claw hammer and assaulting McPhee by trying to hit him with a dog lead.

The court heard Gallagher, an alcoholic, had become the source of resentment in his small hometown over his 2013 win and had relapsed into alcohol abuse around the time of the offence.

Following the bar brawl, he moved away from the area, buying a log cabin in the coastal village of Wemyss Bay for £90,000.

Sentence was deferred until today so Gallagher could be interviewed by social workers about the circumstances of the offence and the best way of dealing with him.

But when Gallagher, a father-of-four, returned to the dock the court heard he had not attended the crucial meeting as Royal Mail do not deliver to his log cabin.

Defence solicitor Rhona Lynch explained: "There is no social work report before the court.

"My client contacted my office to advise that he had not received a letter from the social work department.

"He then contacted Inverclyde social work department to say he hadn't received the letter.

"Their office said it had been sent to the office at Wemyss Bay Holiday Park.

"The appointment was due to take place on Monday, September 28, but he had to try and rearrange the appointment as his mum had a hip replacement operation and he had the kids and couldn't make it."

Sheriff James Spy said: "I am aware from other cases that the Post Office won't deliver to particular units in a caravan or holiday park."

He said the social work report not being available was "unfortunate" and adjourned the case for four weeks for the report to be prepared.

The sheriff previously said there was "no point" fining Gallagher due to his lottery windfall and said he was "concerned" Gallagher had armed himself with a hammer.

Gallagher could be jailed for as long as 12 months when he returns to court.

A Royal Mail Spokesperson said: “This postcode is only registered to Parkdean Holidays Plc and we deliver to the office at this address.

“There are no access roads for the postman to deliver to individual cabins.”
