A post worker in Oxford has won his job back after workmates struck to demand his reinstatement.
Stuart Baker had worked as a postal worker for 34 years when Royal Mail sacked him last May. He was accused of “wilful delay” after some mail got left behind when it was unloaded from a lorry.
“It was a nightmare,” Stuart told Socialist Worker. “I’d lost my pension, everything.
“I’d read about the treatment people faced in other offices and never dreamt it could happen to me”.
After an unsuccessful appeal, Stuart’s workmates at the South Central No.1 branch of the CWU union went into action to get his job back.
Every worker in his office walked out on a one-day strike in September last year to demand his reinstatement.
“I’ve never seen such a solid turnout,” said Stuart. “It really pulled at the heartstrings.”
A desperate Royal Mail agreed that if Stuart won a tribunal he would be reinstated. The union postal branch paid for lawyers.
Paul Garraway is the union rep who was directly involved in the case. He said, “The solid support for the strike showed the strength of feeling.”
Stuart was exonerated at his tribunal at the start of the year. He has now returned to work.
“I got a round of applause when I came back,” he said.
“I have so much praise for the union. I can’t thank them enough.”

For pete's sake don't these managers know the definition of 'wilful'?? 34 years and presumably a good record and his pension risked because of one mistake? Where's the common-sense when deciding the poor bloke's future? Well done to his colleagues and the CWU to have this evidently unreasonable action overturned at tribunal. I hope he was paid between his suspension/dismissal and re-start of duties to make up for the stress which must've been terrible.

it would have been better to have the walk out before the appeal not the tribunal as its cheaper and doesn't get RM off the hook.

Firstly,it tells you that the person who decided to dismiss, was an idiot ,secondly ,it shows what a waste of time the appeals process is,thirdly,as you point out,do they not know the definition of "wilful". Do manager's receive any training ,apart from how to be postmen when you run out of staff and how to bully and harass people. What a nasty company to work for.

No but RM can take back everything they have paid in, I think it depends on what you have been sacked for.

However, as stated above, RM can (but not necessarily) take back their contributions.
They may also, depending on the reason for dismissal, take some of your contributions under civil recovery, to compensate customers etc.
