A CONVICTED thief who tried to cash a cheque which was among a bag of mail stolen from a postman in Solihull has escaped being jailed after a Judge praised efforts to turn his life around.

Leon James claimed to have found the cheque for £968 in the street near his home in Coleman Street, Tile Hill.

The 40-year-old and a woman, who has since been fined by magistrates, went into the Money Shop in Corporation Street in the city centre and tried to cash it.

But staff members were suspicious, and when they went to the back of the shop to call the police James - had previous convictions for offences including theft, robbery and burglary - and the woman left without getting any money.

He was later arrested after his fingerprint was found on the cheque.

Prosecutor Nicholas Smith said the mail bag was stolen while a postman was making deliveries in Widney Manor Road, Solihull.

Among them was one to a woman living in that road which contained the cheque.

At Warwick Crown Court last week James pleaded guilty to stealing the cheque and fraudulently trying to cash it. He was given a 12-month community order with 12 months supervision.

Recorder Abigail Nixon said she had read ‘the positive content in the progress report’ on James.

And Recorder Nixon told him: "Of course the offence you committed back in August last year was serious and ordinarily you would be worrying about receiving a custodial sentence.

"But I note you are making real progress at the moment. You have stable accommodation, you are engaging well and you are drug-free. It is an incredibly positive step for you."

Why bother taking it to court,in fact why bother working when you are encouraged to steal anything you need,what a state of affairs.

The postman who had his bag stolen probably received a stiffer punishment.
