National Agreement RTD/Professional Driver - Pay Clarifications

Further to LTB 171/07 containing the above Agreement many Branches/Representatives will be aware that since the introduction of the Professional Driving Grade in April a number of difficulties have been reported to CWU Headquarters in relation to the application of the Area Distribution Drivers Pay Arrangements.



In summary the main problems being encountered were:



The overtime rates for both Professional Drivers and qualified OPGs who perform Professional Driving work.


The Substitution arrangements for individuals who decided to perform Professional Driving duties within rotations, on an ad-hoc basis or when there are Bank Holidays/4 day weeks.


The accurate recording of individuals Scheduled Attendance to ensure an average can be calculated for the purpose of Holiday Pay.


It is unfortunate that due to the current Industrial Dispute it has taken longer to conclude our discussions with the business in order to rectify the varied interpretations being placed on these issues in some areas and by the Pay Unit. I am now however able to report Revised Pay Guidance has now been agreed to ensure that the terms of the Agreement are applied properly in the future and any errors that have previously occurred are corrected.



I have attached a copy of this Pay Guidance which the business have also now published and will replace all previous Directives that have been circulated. Representatives should note that all underpayments will be recalculated and backdated to the 2nd April 2007 . It is hoped that this exercise will be completed and payments received in week commencing 24th September 2007 .

Please find below the updated RTD comms to help you out with the ways of working for RTD.



The following information below is there to help you with the necessary changes ongoing with your staff. This email is being sent to anyone who has contacted me regarding RTD so could I ask for you to pass the information onto anyone in your area who this would help as I know this communication wont hit everybody, so your help would be greatly appreciated to smooth the way to making RTD as painless as possible for pay related things giving you the time to concentrate on your day jobs. RM Letters & Network are included in this send out so I will clearly state the process for each on here to avoid confusion.



Moving people to and from professional drivers grades.



This process is the same for both business units, via completing an ECR. The ECR has always been the file to use for changes to peoples contractual information so should not be new to quite a few of you. The grades for professional drivers are as follows;



MGV = MGV 7.5t tacho driver

LGC = LGV Class C driver

LGE = LGV Class C+E driver

Paying Professional Driver Pay in Mixed Rotations or on an Ad-Hoc basis



Payment for rotation: If you have any non professional drivers who perform professional driver duties within their rotations then the process would be to pay substitution. The substitution payment should be the difference between the driver's basic pay plus MGV Allowance and the basic pay of a professional driver i.e. £380 per week. The substitution rate should be applied for the week on which they perform the professional driver work, and not on an hourly basis. Please don't use HR19's as this will not allow for the correct substitution rate to be applied.



Reserves: If you have a person performing professional driver duties as cover (reserves) on an occasional basis they should be paid substitution for the week they are covering the professional driver role If however a driver is a reserve covering only professional driver work on a full time basis, they should be formally recognised as a professional driver and paid in line with the standard professional driver duties. See the previous point (moving people to the professional driver grade) on how to set this up.



Ad-hoc payments: Where a non-professional driver performs some ad-hoc professional driver work as part of their conditioned hours they should be paid substitution for that day's attendance. However if they perform this work during overtime hours they should be paid only the overtime element at the professional driver rate, and no substitution should be used.



The form can be found using the link below. In the "grade substituting to" you will need to enter one of the following grades;



MGV = MGV 7.5t tacho driver

LGC = LGV Class C driver

LGE = LGV Class C+E driver





Paying substitution in weeks of bank holidays or people doing a 4 day week attendances



Where there is a 4 day attendance due to Bank Holidays etc and substitution is performed the full weeks attendance needs to be paid and not just the 4 days substitution. This is the same case where employees perform substitution but work a 4 day week.



To do this you need to put the number of days substituting as 5 and in the number of days in duty will need to be 5 as well.



If your employee has only been paid for 4 days and not the full week you will need to submit a substitution sheet to pay 1 days worth of professional driver pay.

Paying Overtime



If a driver performs overtime as part of their driving duties they are entitled to be paid at the enhanced rates of pay.



RM Letters



For MGV drivers in RM Letters Areas the 1st 8 hours of overtime is to be paid £9.50 regardless of the type of overtime performed. This needs to be recorded in the driving overtime column e.g. Joe Bloggs does 4 hours driving & 4 hours indoor work. The full 8 hours needs to be recorded under the driving overtime for them to be paid the £9.50. Please don't put 4 hours in the driving column on the spreadsheet and 4 hours in the OPG overtime column.



This is to be backdated to 2nd April 07. Any re-calculation of overtime will be performed by P&ODS and should be paid in week commencing Monday 24th September 2007 .



If overtime is scheduled attendance this needs to be recorded as SA. The driving overtime is for pressure overtime etc that is NOT scheduled attendance. This is important because SA hours are picked up in the SA calculation when staff are on leave and paid twice yearly. If no SA is claimed each week the payments will be lower to the driver in the next financial year.



For LGC Class C drivers (LGC) this is paid at £13.50 ph and for LGC Class C+E drivers (LGE) this is paid at £15.00 ph



If you have non professional drivers doing overtime as a professional driver they are entitled to the rate of pay for driving i.e. £9.50 in RM Letters and £13.50 or £15 in Network)



If a C1 (MGV) professional driver performs C or C+E professional driver overtime it will be at the higher C or C+E rate. Similarly if a C or C+E professional driver performs C1 overtime it will be at the lower C1 rate.



Filling the overtime form in Network only



Please use the form below; the sheet (tab) name is OT-SA. For all indoor overtime all the columns excluding the last 2 (S and U) can be filled in for the appropriate overtime. For all driving overtime the last 2 columns are used depending on the type of overtime done (LGC or LGE work). I have attached an example document that has been pre-filled in to show how this is needs to be done



Example 1 Jo Bloggs is a professional driver and has done 15hrs Class C+E overtime and has also worked indoors and has done 10 hours weekday ot and 2 hours Sunday





Example 2 Derek Trotter isn't a driver but has done 10 hours Class C driving so would be entitled to 10 hours overtime at £13.50






Filling the overtime form in RM Letters only



The RM letters overtime workbook has been sent out to all bookrooms, if your bookroom doesn't have the docket please contact the Specialist Pay Centre in Redhill who will send you the workbook out. Due to the VPAY sheet being personal to each unit I am unable to send the form out but the principal is the same where the appropriate drivers overtime goes on the "Professional Driver Overtime" sheet up to the limits outlined in the guidance above, and any other overtime goes under the "Scheduled Attendance" or "Pressure OT" sheet as per the norm.



Changes to drivers shift patterns



This process is the same as pre RTD, which is to fill a HR17 form in. The form can be found using the link below, the grades would be as follows;
