Former postie back in court for breaching order

A FORMER postman who failed to deliver thousands of items of mail has been spared jail for a third time.

Mark Scott was back in court for breaching his suspended sentence order.

The 27-year-old, who admitted taking cash from birthday cards and keeping bags of undelivered mail at his home, was last August given a four-month jail sentence suspended for a year.

He was also given a 12-month supervised community order and told to do 200 hours of unpaid work.

But three months later he breached the order by failing to comply with the unpaid work requirement.

Magistrates were persuaded not to jail him and instead gave him another 12 hours of unpaid work.

But yesterday Scott, of Collingwood Street, Felling, Gateshead, was called before the court again and admitted failing to attend supervision and unpaid work.

Gateshead magistrates heard that he has made excuse after excuse for not doing unpaid work, only completing 76 hours.

In a report, his probation officer Emma Reese said he has “willfully ignored and persistently evaded” attending for unpaid work because he feels he had been punished enough.

“Despite being tearful and remorseful at his first breach, his behaviour and attitude have not changed,” she said.

Her recommendation was for the suspended jail sentence to be activated.

But magistrates were once again persuaded to let Scott keep his freedom.

His solicitor, Michael Foley, said Scott’s job requires him to work long hours and he is making attempts to complete the court’s requirement.

“You don’t have to send him to jail, he is not out committing offences, he is out working hard and that should be encouraged,” he said.

“He is not the sort of person who should be sent to jail. He is no danger to the community, he is not violent. What would be the point of sending him to jail?

“We would be paying a lot of money to keep him in jail when he could be working and paying taxes.”

Magistrates sentenced him to another 20 hours of unpaid work and extended the order by another 12 months.

Chairman of the bench Stuart Lowerson told Scott: “We are not in the business of putting people out of work and for that reason we are not going to activate the suspended sentence.”

But he warned: “If you breach this suspended order again, you will go away.”

Just think of the cost every time the courts have to deal with this tw*t. Start taking money out of his current "hard working" job he has!

The attitude would soon change!
