Tory Plans to make it easier to hire and fire

The new “employers’ charter” will allow companies to sack workers during the first two years of their employment without the threat of being taken to a tribunal for unfair dismissal.
Currently an employee can bring an unfair dismissal claim after only a year.
To reduce the number of vexatious allegations, workers will face a fee when lodging an employment tribunal claim.
The Daily Telegraph can disclose that the Government is also launching a review that is likely to see small companies excluded from some stringent employment laws. The length of time that firms have to pay workers statutory sick pay is set to be reduced as part of the shake-up.
David Cameron hopes that relaxed employment laws will help to boost the private sector and encourage firms to take on thousands of new workers.

Downing Street will host a jobs summit on Monday at which some of the biggest employers – including Tesco, McDonalds, Microsoft and Shell — will promise to take on thousands of recruits and create apprenticeships for school leavers.
The issue of jobs is likely to dominate the first day of the new parliamentary session as MPs return after the holiday recess.
The Coalition will try to focus on its plans for economic growth, rather than public spending cuts.
Mr Cameron said: “We can only get our economy back on track by creating a climate in which the private sector can grow and develop, creating jobs and opportunities for people across the country. This year the Government is determined to help deliver many thousands of new jobs and I’m delighted that the companies joining me today are part of that.
“Across a whole range of areas you’re going to see the most pro-business, pro-growth, pro-jobs agenda ever unleashed by a government.
“It’s time we looked forward to a positive, strong, confident Britain. By developing the right skills and jobs I am determined that the many, not the few will share in the country’s prosperity.”
In total 19 major employers will attend today’s summit with other firms including Balfour Beatty, Centrica, Jaguar, Land Rover and Marks and Spencer.
Downing Street said the Prime Minister would talk to employers about “what more the Government can do to enable employers to get Britain working again”.
Currently workers can pursue a claim for unfair dismissal after a year of full-time employment.
This is expected to be increased to two years, a move that does not require new legislation.
A similar rise was introduced in the 1980s, leading to an increase in employment. The one-year limit was proposed in 1996 and enacted by the Labour government.
Claims for discrimination can be lodged after any term of employment.
Companies also have to pay statutory sick pay of at least £79.15 for up to 28 weeks to those unable to work. The period of payment by employers may be reduced in future.
Mr Cameron is expected to order a wider review of employment laws to slash the red tape for smaller companies.
These firms are seen as the key to securing the economic recovery and encouraging the next generation of entrepreneurs.
Many small and medium-sized firms complain that they are being hindered by employment rules introduced over the past decade.
Ministers are expected to contrast the “employers’ charter” with the European-led social charter introduced by Labour which boosted workers’ rights.
A Whitehall source said: “The thrust of the initiative is that to persuade companies to hire people we need to make it easier to fire those workers who aren’t up to the job, so there is less risk in taking on new people, especially the

That's quite worrying, even though it may have no relevance to RM. And even though it's only one of the (known) measures being considered, it doesn't look like anyone else will have much say against it. Apparently, Downing St. will be setting up an online presence for small-business peeps to air their 'horror' (zombie) stories.

This following quote, in the same article, makes me wonder just who (and what kind of a public majority) in Britain would allow this sort of decision to be made...
“This Government is a very strong government. It’s got a strong majority. I believe the public is right behind the approach that we are taking and people need to know we will not change course because one union or another union wants to kick off.”
We posties do things differently, but we still get shot at!

Our (other) men and women deserve a little more... http://www.helpforheroes.org.uk/

...............Every 2 years.

Cheers Liebour - No repeal of the Anti Union laws and now the Cons are after the workers again - Labour really have let the workers/trade union movement down and we still keep giving them donations. Why????????????????????????????

Tony Blair the Pink Conservative should be expelled from the Labour Party.

..but TBT it would only be used to get rid of skivers...and anybody you didn't like...and smelly people....and anybody who dared say no to the boss.....and ugly people....and anybody who doesn't like the minimum wage.

Small businesses need this flexibility to grow and recruit all of these millions who will get this once great country back on it's feet....
Although i'm slightly confused as to how making it easier to sack people helps a country "grow" but i'm sure somebody will explain later.

I've already looked out my cap ready for the doffing. :Very Happy

Re Torygraph article - Marks and Sparks don't recognise unions ....they have a " open door policy " ....er yeah right :chuckle .....Leighton had the same with ASDA ....very anti GMB , Balfour Beattie are a typical True Blue Tory to the bone , anti union firm .....these big building firms like to sack a few people every week to keep people on their toes and use Blacklists .....it's no coincidence that RM's engineers went on strike as these firms try derecognition in all but name if RM are the " sleeping partners " .

The Tories under Major got a opt out of the Social Chapter ...saying things like the EU Working Time Directive would put people on the dole . New Labour went in for it ...but it was the most watered down version possible due to CBI lobbying pressure & wishing to be business friendly ....they would argue that it neutralised the Tories who incidentally were tearing themselves apart over Europe and they would say it would push the Tories further to the right as the centre was too crowded ...which they have gone ...now they pretend to be centralist due to very slick marketing and incessent propaganda ...but it was a damn sight better than nothing :hmmmm

The Camer-con Tories have always wanted EU Directives & H&S " watered down " ....ironically his cabinet are comprised of failed former leaders & ministers like IDS , Dracula & The Fighting Feotus that were too right wing to be electable . Call me Dave is under a lot of pressure from his right wing EEC sceptic rump and these Captains of Industry that think Employment Law is too weighted towards the employee ....it isn't ...in actuality ....it's very weak & toothless with many paper tigers

. The Tories don't mind EU Directives as long as they're free market ones or the ERM under Major ...Monetarism a la Thatcher through the back door .

As for Tribunals ...Labour got it back to 1 year ....then the right wing of New Labour like Blair and Nurse Ratched came under pressure for too many Industrial Tribunals , Johnson tried to make out he'd got a concession , the fair and reasonable employer test was dropped , firms like RM could fit people up providing they'd followed their own due procedure ....e.g. Burslem BUT ACAS would step into the brink and work their " magic " :chuckle . In short it's " we're c**ts but that Toffee nosed lot are absolute t**ts "

That idea that they are proposing is a Keith Joseph 80's idea ....Joseph was regarded as a hair shirt by his own ...it's a nice way of saying Nutter ....it works to a point .....but it can be " How long have you worked here ? A . 25 yrs " I don't like the tone of your voice , f**k off and get your cards " ....then the worker is replaced by the bosses son . You are also likely to end up in some unit on a Ind Estate in the middle of nowhere with H&S out of the window .

The other thing they're trying to bring back is the 90's " Age Of Deference " .....Be I ever so humble Sir ....You're a Toff make no mistake " ....My experience was you ended up with Concentration Camp Mentality and Management ....That Bastion of Socialism ....The CBI ..... criticised it for being inefficent .....as eventually the chickens come home to roost .

Basically it is " Do you want to tolerate necessary evils ? or shall we go all high and mighty and fall on our inherent contradictions eventually ?

http://cameron-cloggysmoralcompass.blog ... nt-is.html" onclick="window.open(this.href);return false; Read this further erosion of our civil rights from this disgusting pea-brained stinking lousy Tory government. Firms get powers to sack the slackers

Companies are to be given greater freedom to sack under-performing workers as part of an overhaul of employment laws to boost the economic recovery.

So can someone explain how being given the power to sack someone is going to help boost growth? How is making someone so scared about losing their job that they will put up with the most appalling abuse, bullying, and unfair demands from employers, help grow more jobs?

Is this really what we want for our children and is this really what a civilised society does, go BACKWARDS? First of all Cameron is reducing union powers, then he makes it impossible for people that have been sacked unfairly to get legal aid and now this?

What is it all for? So the Government does NOT have to pay public sector workers who have worked for under two years redundancy or severance pay?

Is this what all you workers who voted Tory at the last election, actually voted for? This and to see our NHS privatised under your noses?

Look at what Cameron is doing, he is working to a plan

First shrink the state

Erode union laws about striking and remove as many workers rights as possible

Cut work related benefits, so when workers lose their jobs their unemployment payments are minimum

Make over 500.000 public sector workers redundant

Make it easier for them to be sacked in first two years

Wriggle out of paying them their proper redundancy packages and severance pay

Make people terrified of losing their jobs

Make it easier for employers to bully and intimidate their workforce

Give employers the right to force people to do the jobs of two or more people

Make it impossible for rushed stressed employees *not* to make mistakes

Make it easier for employers to use those mistakes and threaten the sack to employees

Employees will not complain because they will be terrified of losing their jobs and not being able to find a new one

Make it ways for employers NOT to pay their staff a proper living wage

Make it impossible for people sacked unfairly to go to tribunal By
Removing legal aid for workers taking employers to industrial tribunals

Kept Employers National Insurance Contributions the same
But raised the national insurance contributions for workers
Do you not see? Cameron, Osborne and Clegg are making it so easy for employers to treat their workforce like scum.

The only jobs available in this country will be burger pushers and shelf stackers at Tescos, hundreds of thousands of people will be trapped in dead end jobs.

The very next thing will be that the Tories and Cameron, Osborne and Clegg will be removing the minimum wage, they will tell you that the country can no longer afford it.

he's shielded by those Liberals ...Even their own papers are turning on him ...the old Guard want rid of them , a snap election before the cuts sink in and it starts kicking off . They've had a lot of time to plot on The Playing Fields of Eton since they did that coup on Baroness Barmy to save their own sorry arses and a lot of unfinished business , this time they're less likely to cock up a la The Poll Tax ...never ever underestimate them , they're criminally devious .

Norbert you are a real gem.
Brilliant thread.
I notice that there is no minimum length of service to bring a discimination case against an employer so basically the poor old white working man is the butt again. The bottom of the heap, the one that is worth the least. I wonder why they hate us so much.

Thanks La Poste back to the 80's & 90's , the pendulum swinging too far the other way , if you turn the clock back too much , you make union membership attractive and cause resentment .

The Tories have sucumbed to lobbying pressure ......these people pay a lot of money to Dave Snooty & His New Pals to be " looked after ". I heard one of these self made women on either Jeremy Vine on Radio 2 or Radio 5 , they didn't get to where they are by being nice ...it's the complete opposite ! and they've prissy , pompous , self righteous & arrogant views to the right of Queen Victoria and would like to take us all back to that Master - Servant era .

There was a right ding - dong with her and someone from the TUC ....usual story ...I'm right , you're wrong ...anyone to the left of Magaret Thatcher is a raving looney Trot ...anybody who went to a Union Meeting is Arthur Scargill . She tried to make out that employment law is too weighted towards the employee , it was " you unionists " when verbally bullying her counterpart .

She was told these tribunals are more to do with the poor management and HR departments that she has under her .

As far as discrimination goes this is about all a bloke like me can hope for:

Ex-Countryfile host Miriam O'Reilly has won an employment tribunal against the BBC on the grounds of ageism:
http://www.bbc.co.uk/news/entertainment-arts-12161045

So if you've been a postie for a while and are getting on a bit in years this might be an area of the law that is worth becoming well versed in.
Ageism is a form of discrimination.

David Cameron displayed a new willingness today to toughen Britain's anti-strike laws in the face of suggestions that the leftwing leaderships of Unite and the RMT are planning a wave of strikes against oil depots, British Airways and transport systems.
