Dog attack Postie’s claim for compensation impeded as owners escape prosecution

The owners of a dog that attacked a postman and left him severely injured will not be prosecuted.

It is unknown whether the injured postman, Keith Davis, will make a claim for compensation for the attack which left him needing surgery in the week leading up to Christmas in 2008.

Judge Gareth Hawkesworth ruled that as the attack took place in a private cul de sac, the owners could not be charged under the Dangerous Dog Act 1991.

Roberts Stewart, 44, and his daughter Emma, 22, were therefore acquitted from being responsible for a dog that had caused injury at a hearing at Cambridge Crown Court.

Prosecutors had argued that the attack was on an unadopted road near the home of Mr Stewart which was a public place. However the judge ruled that the road was private and therefore the rules did not apply.

Now, the Communication Workers Union (CWU) is trying to have the Dangerous Dog Act 1991 amended to include attacks that happen on private property.

A spokesman for the CWU said: “It must be amended so it applies to both public and private property because about 6000 members of the CWU are attacked by dogs every year. Thousands of our members visit people’s property daily – if they’re attacked the union will always look to prosecute and get compensation.”

This makes me sick if the postie had turned burglar and entered the premises and was attacked bet he'd get results then. The system always seems geared towards the perpitrators.

I can see now why, my "dog attack" owner is stating that their dog couldn't have possibly chased me onto a road - which it did!
They're trying to say it all happened on their property...even quoting the Laws regarding this aspect of Home Insurance etc.

They even stated that their car was blocking my way onto the road, and...cue Cilla Black, "Surprise! Surprise!" this is where it's being parked NOW.
If it HAD been parked where they say, I would have had no escape route from their little darling.

So now people who have dogs won't get mail, even its it friendly. Telling them to collect their mail.

I don't think we should deliver to private propertys if we have no protection or come back when we get attacked.

I think you may have something there. If we are uninsured on private property then that must become an offence under the H&S at work act!!
To knowingly let your workforce work in areas that they are not insured in could lead to a major prosecution against Royal Mail. Wouldnt it?, couldnt it?, SHOULDNT IT!!!

Here's the answer: 1. EVERY HOUSE to have an outside box/safe area box.
2. These are to made by the "Scrotes" who are in prison for having Dangerous Dogs.
3. Additional boxes to be made by the "I want to work, but can't get up in the morning" teenage brigade, lessening unemployment.
4. Anyone NOT having a box, gets, a. No Mail or b. They have to collect it.
5. The "Time" saved to RM can be ploughed back into, letting us do the Job without sweating buckets, knackering our knees, getting bitten/injured.
6. Yes, this a Rant, but...it would solve many problems at once.

Well, if it goes all the way to a guilty verdict, wouldn't that make it a test case that we could use in future ( God forbid that we should need to )? Any chance of linking the story of the Fed getting bitten?

If the cop wins and none of us do can't this be seen as discrimination by the courts.

Man charged after dogs bite officer

A man has been charged with possessing dangerous dogs after a police officer was attacked and bitten by two pit bulls, Scotland Yard said.

The 57-year-old police constable had about 15 bites to his chest, face and arms, a spokesman said.

The incident happened shortly before noon on Tuesday in a garden in Sladedale Road, Plumstead, south east London, next door to where officers were seeking to make an arrest, the spokesman said.

The injured officer was taken to a south London hospital and has now been discharged but remains on sick leave.

Raymond Vickles, 55, of Sladedale Road, will appear at Woolwich Magistrates' Court on Thursday charged with two counts under Section 1 of the Dangerous Dogs Act (possession of a dangerous dog that falls within the terms of the Act), and two counts under Section 3 of the Act (allowing a dog to enter a place which is not a public place but where it is not permitted to be, and while there injures any person).
There are two counts because two dogs were allegedly involved.
