No even if and thats a big if there is a problem with the issuing of the notice the union would simply have to name more dates. Wouldn't be very professional though would it!!!

if he gets his way,does that mean we wouldnt even be able to go on strike by law?he could just get the high court to pass law over any strike action..

If the 7 days notice has not been served surely this would only effect Mondays action which could be withdrawn and recommenced on the following Monday.

The statutory immunity of trade unions from liability for inducing breach of contract when calling on members to come out on strike or to take other industrial action depends on the union having the support of a ballot. Further, whenever they undertake a ballot concerning proposed industrial action trade unions must give at least seven days notice to the employers of all members entitled to vote, complying with the specific requirements set out in TULRCA 1992 ss.226, 226A and 234A, Failure to comply with these requirements will mean that the unions concerned will forfeit their statutory immunity (see notes at Trade union matters/immunity from civil action in certain cases ). This happened to the Union of Construction Allied Trades and Technicians in a High Court case heard in November 2003 in which Willerby Holiday Homes Ltd won £130,000 damages from UCATT after that union had failed to give the required seven days formal notice of its intention to ballot, did not correctly ballot everyone in the union and did not give the statutory seven days' notice before bringing members out on strike (note in Contract Journal on Willerby Holiday Homes Ltd v UCATT, Dec 2003).

Looks like Crozier could be going after the unions funds.

Phew!!! Thanks for that, and your right, its not very professional If this is indeed another screw up, then someone at headquarters needs to be sacked or kept out of harms way , because this has happened before!!!

There is nothing wrong with the notice i hear. Royal Mail are using that to make the union look silly. It is the unofficial stuff that is causing the problems! Royal Mail are saying the issues people have walked for are part of the national dispute therefore it annuls the ballot and they can attack our funds. Lets wait and see!!!

Looks like RM are pooing themselves 'cos of the growing back log!

Maybe RM want to stop the new strike dates by claiming we were on strike when the notice was issued.

RM have seen the state of all the backlogged mail thats in the system and are panicking because people are posting what they should have posted last weekend now and with next weeks strikes will cause absalutely mayhem and they know it, so this is just an attempt to delay the strike to get on top of the back log. So CWU you know what to do counter their claims and F*CK em
