Resign but wants job back

A bloke in work resigned 2 weeks ago but then changed his mind 4 days before his last day.

Does he have an chance of getting his job back. the local rep is looking into it and he's taking out a grievance but he didn't sound to hopeful.

Anybody know if he has any chance.

Did he get a response ie an acceptance of his resignation? Might be crucial. If he did it's done and dusted and he needs to think a bit harder before resigning next time.

Could he say he wasn't in a fit state of mind following a traumatic incident? Something must have happened like that for him to resign then change his mind?

Yes he did get an acceptance.

He also tried "a bit confused and personal issues" but no joy yet.

He would need at the very least a letter from his GP confirming mental instability - an argument with the Mrs wouldn't cut it. Bereavement, bankruptcy, that kind of thing could be a mitigating circumstance but even if he went to an employment tribunal (if such a case applies) there's no guarantee of success. His best bet might be to go onto RM website and re-apply when/if vacancies come up.

There are several factors to take into consideration firstly by tendering his resignation he has broken the relationship in the Employer/Employee terms of his contract of employment that has been accepted by the employer. On the other hand what is his service record like such as length of service, timekeeping and disciplinary record ( if any) which employer would weigh up against replacing him, costs for retraining a replacement, staffing levels and office budget and this would be put forward by union rep for reconsideration of his resignation and personally I would have preferred to have taken this approach instead of a grievance. There has been instances where other employees have resigned to take alternative job opportunities and have decided to return to RM and this was done after having tried the other employment which didn't work out and was accepted back without loss of seniority. Unlike this case that the change of mind was before the actual resignation date. You will realise that each office in this business has different ways of working and what is acceptable to one office is totally different to another. Whether its RM or any other employer it will not be the first time or the last that an employee has regrets in handing in their notice and a reasonable employer taking into consideration the factors which I have mentioned in my posting should be able to come to a decision if its to the benefit of the business to let him go or stay.
