GOING FURTHER THAN LEVEL 3 GRIEVANCE?

Post by Mezza »

I'm currently waiting on the outcome of a level 3 Grievance hearing.
I was told at the hearing that the outcome would be the end of the matter and there is no right to appeal against it.

Now originally i was told after a Level 3 Grievance i would have the right to go to Employment tribunal (ACAS), if i was still unhappy with the decision reached.
I have since learnt that there is apparently a timescale on taking cases to ACAS.
My Grievance has lasted almost 4 months now and has missed the date for going to ACAS if i wanted or need to - as RM have delayed my case time and time again.

So having read of so many cases being delayed is the real reason the fact that it then means there is no right to go any further than Level 3 Grievance. Which means RM can fob me off with any reason or excuse they like as to why they are right and i am wrong and i just have to accept it?

Does anyone know if there is a way of taking cases beyond Level 3 or if indeed there is a timescale for ET?

for an ET claim, the timescale is normally within 3 months of the situation arising, if you have been in talks through the grievance procedure and trying to resolve the issue like you have then normally your ET claim will be accepted for 3 months after the end of the grievance procedure, but it is down to the court who will be hearing your claim to accept this extra timescale, theres no hard and fast answer unfortunately

I had a grievance over docked o/t and loss of meal breaks. RM spun it out for over 2 years and so I've also been told by my rep I can't take it to acas or a tribuna,l due being out of time. How can this be justice? My case was mis-managed from the start. Evidence was 'lost' during this time and witnesses left the business, to further weaken my claim. Why am I again being punished for RMs despicable behaviour?
