Going To Disagreement

Our office has worked a 1 in 6 attendance pattern for years.
However, the indoor staff negotiated a 1 in 4 attendance pattern over 12 years ago, as a sweetener for indoor staff working their full hours when delivery staff were making time through job and knock.
The 1 in 4 attendance was agreed with our next DOM and has never been an issue for any other staff in our office - simply nobody wants to do the indoor duties as they know they can never make any time.

We are now going through our revision and as a part of this there was an office vote at the end of July concerning attendance patterns. the office voted to stick with the current 1 in 6 rotation that has been in place for years.

The indoor staff had a meeting with the DOM mid September to address various impacts on our duties through the revision and i asked if we would still follow our current attendance pattern of 1 in 4.
Our DOM informed us that he had no idea we were doing a 1 in 4 and that as the office had voted for 1 in 6 we would have to follow suit.

We have lodged a Disagreement as this is in direct breach of the 2010 agreement concerning attendance patterns. Where it mentions that if it has no impact on service and performance etc then where possible staff would be offered a 1 in 4 pattern. It also mentions that attendance patterns would not be changed if it means staff would be worse off than they were before.
There was also the letter we all got from Moyra the other week where she mentioned there would be NO changes to existing agreements ( although our DOM says we have taken this out of context).

I wonder though, if our DOM is pleading ignorance to the fact we have always followed a 1 in 4 (amazing after 3 years of him being here), how on earth can he say that the office vote on attendance patterns included us?

Our Area rep says we have a good chance of winning this disagreement, simply for the points mentioned in the 2010 agreement.

But does anyone think that our DOMs argument that the indoor vote included us, holds any chance?
