I've worked in processing (for 20 years) and have suffered from back problems for many years (about the last 15 years).
I'm OK doing most jobs in processing, it's just the bag tipping job that always gives me problems.
In the past I have been referred to the Royal Mail health department/ATOS, and managers have always been understanding of this problem and I have always been excused from doing tipping.
The last time I had a referral to ATOS regarding this was 4 years ago (when I had a phone interview).
The other day I was challenged by a manager regarding this - asking me if I had been referred to ATOS etc. After I told her that I had, but it was 4 years ago, she basically told me "that's too long ago - that's obsolete".
I was under the impression that that information was held on my records somewhere?
Can anyone tell me:
1. Should the details of my back problem still be on my records, or do they just delete it after a certain amount of time?
2. How often do I need to be referred to ATOS with this problem - do I need to do it once a year or something?
3. If a manager asks me to go on tipping and I refuse (as I know it will give me back problems if I do), am I within my rights to refuse or will I be liable to disiplinary action for refusing to obey instructions?

i would follow mgmt instructions until problems occurs then go back off sick and fire in a claim

unless ATOS were going to review your situation i would say that their advice remains until they change it.
I would request a copy of my records which the business should be able to provide inside of 24 hours
If this manager instructs you to perform tipping remind her of the ATOS recommendations,should you unfortunately suffer a occurrence of your problem get in touch with the DWP to report an accident at work/industrial injury.
The point being this,
You informed the business/manager of your injury, the ATOS recommendation and the potential outcome, therefore making them aware of this hazard and yet they persisted.
It will then be regarded as an industrial accident and an AOD, and you may be able to pursue compensation.
Hopefully it won't come to that though.
