Dear Colleagues,
Use Of Agency Workers During The Postal Strike
We are aware that large numbers of agency workers have been brought into the Business to work in Royal Mail sites, prior to, and during strike days. At the beginning of the dispute, I wrote to the company and all employment agencies likely to provide staff to Royal Mail, to remind them of the restrictions on providing resource in industrial dispute situations as outlined in Regulation 7 of the Conduct of Employment Agencies and Employment 2003.
It would seem that Royal Mil is attempting to circumnavigate these regulations in the timing of agency deployment.
I can assure you that we are doing all that we can to restrict this practice and we will of course consider all options, including legal action.
In the meantime, I have written again to Manpower and Reed Agencies on specific reported cases and we will be making a formal complaint to the Agency Enforcement Inspectorate. In addition we have raised the matter with the Recruitment Employment Confederation.
We would ask that Branches keep us informed of such instances so that we can continue to raise these matters as appropriate. We would need precise details of these abuses so that our representations can be specific.

Agency worker spotted going in on Saturday 6th Oct
Not sure about this but we think that an Agency worker went in on Saturday morning at our office. He was dropped off by his friend (?) in a car, outside the office and he most definately walked around the corner of the building (heading towards the doors).
We didn't see him come out of the building later on either, this was at about 8:15-8:30am...!
So what exactly do we do if we see Agency workers going into 'work'? Do we stop them or do we voice our complaints rather loudly to make management come outside or what?
If we use camera-phones etc to record these incidents, we are being accused of using these images to allegedly 'threaten' people with them, as was previously implied by a manager when a photo was taken of an RM lorry arriving at our office on the picket line during the one day strikes.
From what I can make out what actually happened was one of the guys just took a photo to see if his cameraphone was still working, as he's had problems with it. He's now got a new phone, as it wasn't working properly at all, just like my phone!!!
I'd like to read that info in the original post (the download link isn't there and I'm having problems finding the actual info on the web. Also I don't know what Agencies our office uses. If I did I'd go there and politely ask them to desist in sending Agency workers in during the strike if it contravenes any agreements that are in place.
Over to you for your thoughts, ideas etc.

Restriction on providing work-seekers in industrial disputes
7. - (1) Subject to paragraph (2) an employment business shall not introduce or supply a work-seeker to a hirer to perform -
(a) the duties normally performed by a worker who is taking part in a strike or other industrial action ("the first worker"), or
(b) the duties normally performed by any other worker employed by the hirer and who is assigned by the hirer to perform the duties normally performed by the first worker,
unless in either case the employment business does not know, and has no reasonable grounds for knowing, that the first worker is taking part in a strike or other industrial action.
(2) Paragraph (1) shall not apply if, in relation to the first worker, the strike or other industrial action in question is an unofficial strike or other unofficial industrial action for the purposes of section 237 of the Trade Union and Labour Relations (Consolidation) Act 1992 [10]
[10] 1992 c. 52; section 237 was inserted by the Trade Union Reform and Employment Rights Act 1993 (c.19), section 49(2) and Schedule 8, paragraph 76, and amended by the Employment Rights Act 1996 (c.18), Schedule 1, paragraph 56(1), (15) and the Employment Relations Act 1999 (c.26), section 9 and Schedule 4, Part III, paragraphs 1, 2(a) and (b).
We can't prove that he actually went in to work....! I use the term loosely (As some Agency workers never do the job properly at all!) All we can do is attempt to find out if this person was actually engaged to work that day and see if any action can be taken.

Agency workers in.... AGAIN!
This post is a bit late, but due to personal reasons I was unable to post this earlier on today. I was originally looking to post this around noontime, after we came off the picket line today.
The upshot of today is as follows:
When I got to the picket line this morning (Mon 8th Oct) I spoke with our office union rep. regarding the postings I've placed on here, as well as the agency info that's on here too. He'd already been in touch with the area rep, regarding Saturdays incident and hopefully action will, and should, be taken. Then, suprise suprise, we found out that agency workers were in our office this morning.... again!
Something needs to be done about this, because from what I can make out from conversations held this morning on the picket it would seem to appear that other offices have had the same thing happen as well!
Royal Mail need their proverbial arses kicked..... and how! They are quite obviously flouting the law and are intent on pushing it to the extreme, I fail to see how D.O.M's and other managers don't know that they are breaking the law. When they use agency staff on a regular basis, surely they must know what the regulations stipulate!
Or am I just being a tad naive?
