Accident on duty

Post by adamanti »

Hi guy's any advice much appreciated, basically had a fall while delivering a parcel, slipped of step as moved back to take photo. Second absence this year as COVID struck last winter. Reported accident soon as back to office, went to A and E , and have been signed off for the next 2 weeks.
Checked payslip and have been stopped 2 days pay replaced by RMs statutory sick pay as per new sick pay policy.
Do I have any chance of appeal here with accident on duty or will it just be my fault I slipped. Thanks.

Contact the employer and ask for your wages to be reinstated. An accident on duty should be excluded from the stage review process. An accident is exactly that. No worker deliberately has an accident.

They are scum even threatened to conduct code me after similar accident on a wonky step. Union eventually squashed it but were wishy-washy

As you were aware of the steps, yet still stepped back causing a personal injury, how can that be the fault of the employer? They will simply state why did you not forsee the hazard with a dynamic risk assessment? Can be classed as Contributory negligence on your part even though it was an unforseen injury.

I wasn't actually aware of the steps until the previous duty holder who also had an accident made me aware. The management did put it in the accident book but wrongly entered it as an uneven patio. He reported the mistake but it was never changed
Luckily I took a photo as it was removed after my accident. As I said management are scum in the main

He probably stumbled and lost grip of the handrail, get your camera out and document the hazardous conditions then negligently blame the OPG without a leg to stand on :thumbup
