Fair and Lawful?

Post by Ahlloyd »

Can anybody please help with this? I had a 7 hours weekly contract with Royal Mail, working each Sunday. I was paid monthly from 1st of the month. Prior to leaving I worked, two Sundays of a month. To my mind 2 x 7 hours and expected 14 hours pay. However apparently because I worked my last shift on the 9th of the month I am only entitled to 9/30th of the months pay which equates to just over 9 hours pay. Is this fair ? Thanks

No, it's utter bollocks. You work 14 hours, you are paid for 14 hours. Have they expressly said that to you? There's not over used annual leave being deducted or anything?

No mention of annual leave deduction or anything like that just this when I queried it :
Your Last Day Of Service was the 9th of June so you were paid for 9 out of the 30 calendar days in June.

I would reply back pointing out that you worked 14 hours in the pay period. It is illegal to pay less than minimum wage for those hours. If you fail to receive a satisfactory response you will make a complaint to HMRC about Royal Mail failing to pay their staff minimum wage.

By the way.If I was on a one day a week monthly paid contract I would have given my resignation date as the 15th June. You would have been paid for half the month and clicked a little bit of extra leave without having to work a minute extra.

That's interesting (not in a good way of course). What does it say in your contract about pay when you leave?

You say you had a 'weekly contract' but don't you mean a monthly contract with seven hours a week (as you were paid monthly)?

Just trying to think how they've worked this out - there were 5 Sundays in June, (and I'm using the figure of £10 p/h to keep the maths simple):

So you should have earned £350 for the month.

They're saying you worked (or in their eyes were under contract) for 9 days out of 30.

So you're due 9/30 ths of your monthly pay (0.3 of your monthly pay).

0.3 x 350 is 105, so equivalent to just over 10 hours pay at the £10 p/h rate I'm using for simplicity.

Yet another thing that's probably been written into the new contracts and brushed under the carpet but don't worry CWU will be fighting for parity
for all contracts (sometime in the future, date TBC, don't hold your breath).

I'd check your contract. You could speak to Citizens Advice or ACAS that this has put your hourly rate below the National Living Wage,
and there's a principle at stake here but how much time do you wish to spend on this chasing up the Royal Mail management shysters for
the amount of money at stake?

Personally I'd feel gutted about it but I'd move on to something better and be glad to be shot of the place.
