Annual leave if off sick
Hi , unfortunately I’ve been signed off sick with stress and anxiety. I’m due to go abroad on holiday in a few weeks .. how does that affect me ? Thank you .

Agree you will need a fit note from your GP to go on a pre-booked trip as you cannot be on the sick and holiday at the same time.
With the fit note, ask the GP to put it will be beneficial to your stress and anxiety

ACAS covers the entire employment sector.
You cannot get sick and holiday pay at the same time.
Even though there is nothing stopping an employee taking holiday entitlement instead of sick leave through mutual agreement, Royal Mail gives full pay when off sick as a contractual arrangement. So why would you use any outstanding holiday entitlement?
Even if the employee takes this option, they would have to go on the sick again on return which will probably be recorded as another sick absence

I am currently off due to an accident on duty, after 4 weeks i was due to take leave , i informed my manager that i was going away for a week , something i had planned and saved for for a year.
He said it would be unauthorised absence and my pay would be stopped, i contacted HR who said that was not the case as i had let my manager know where i would be between x and y dates.
My GP and hospital doctor both couldnt understand the problem as the break (literally in this case) would do me good.
My manager saw the email from HR but ignored It as he was under instructions from his manager .
So here is the paradox, my COM says if i go on holiday I'm then fit to work, but when my holiday was over I then had to get a new note saying i was unfit to work again
So why dont RM now say i should be back at work . CWU area rep agrees with RMs interpretation.
Needless to say my GP shook her head when i had to take up valuable appt time to get new note .

COM and his boss don't have power to overrule HR when there is this sort of corporate internal difference of opinion. Why? ..because HR have lots of power at board level ( because workers cost money - not cos they like us!!). HR are basically the corporate interface between you and royal mail and the contract that joins you. It's HR who have the expert eye on employment contractural relationship and of course whilst they are not always right in law in many cases, if they support you as in this instance (correctly), then you can relax. The COM and boss can write what they know about employment law on the back of a fag packet and wing the rest.
