Hi all,

hoping to get some advice with an issue please.

There's a union member in my office who's been off sick for the last 4 weeks with an apparent bad back. His contacted me (deputy rep) today to tell me his on annual leave this week but that his doctors certificate ended Saturday 20th February, he wants me to relay this info to management. He also told me his condition has not improved and his likely not to be back next week.

So, here's where I'm confused on the issue. If I tell management tomorrow that his doctors note has expired the Saturday gone, they'll take him off his current sick leave period. If his not back next week, he'll have to declare himself sick again. Is this the best course of action for him to take? My opinion is his better staying on the one continuous period of sick. If he takes himself repetitively on and off sick leave, management could potentially take him down the conduct route, which I would like to avoid.

P.S why doesn't he contact management himself. Well, with management staffing issues related to COVID, management changes day to day if any show up at all.

Yes he should stay on the one continuous period of sickness and he will also get his annual leave credited back to him
If you tolerate this, then your paid break will be next
