Is it legal to hire a private solictor instead of industrial action?
They are changing Saturday hours in our office and I have a feeling it may run to a ballot but could we each pay a weeks wages and hire a solictor instead ?

It would be pointless unless the action was illegal.Spedley wrote:Is it legal to hire a private solictor instead of industrial action?

I figure that there must be some law relating to moving 15 minutes per day to the saturday delivery and there must be many laws we don't know about. I have little faith in the union (it's good for small personel problems by poor for mass action).
If this plan is voted out I guess they will do it anyway or we can walk out and if we walk then RM can hold out longer than we can. The only other option I can see is to not play by RM rules and hire a solictor. If after the £20k is gone we have lost then we go back to work knowing there was nothing we could do and all it will cost us is a fixed weeks wages.
I think it could be a good gamble with minimum losses against an unprepared Royal Mail.

Google your problem and see what it comes up with, alternatively ring the legal section of the union who WILL give you impartial advice - my advice would be collect the money and treat yourselves to a day at the races - you may win there.
It would not be in RMs interest to break the law, because sooner or later the discrepancy would be discovered and leave themselves open to a myriad of claims.

its not against the law mate and would be classed as industrial matter. Give Simpson and Millar (Unions Solicitors) a bell on 07808551600 they should put you onto the right channelsSpedley wrote:I figure that there must be some law relating to moving 15 minutes per day to the saturday delivery and there must be many laws we don't know about. Or give ACAS a ring as they offer free advice as well. As a last resort also try the Citizens Advice Bureau they are usually pretty good and are free as well.lovejoy wrote:its not against the law mate and would be classed as industrial matter.
