Hi

If a worker doers overtime at either the start or end of their shift and it takes them over a break threshold are they entitled to take or claim that extra break time.

eg. Start at 0500 to assist IPS. Official shift time is 6:00 to 14:40 . Total hrs worked is 9hrs 40mins. So should you be due an extra 10 min break (50 mins instead of 40mins)

or

Start normal time 0600 finish at 15:10 due to overrun of delivery (worked 9hrs 10mins) Again entitled to an extra 10 mins?

Yes the breaks are based on daily attendance, not contractual hours.
