Equality question

I work at a large mail centre in the south and a few weeks ago an ag was made up to line manager no job was ever advertised internally or externally the shift manager walked up to him and asked him if he wanted to be made is this legal I was under the impression that under the equality act any job going should be advertised so every one could have a fair chance of applying also I know the ag has not even done the managers course he was an ag on Friday then on Monday in charge of a work area he has been going round taking people in the office he tried taking me in to the office I said to him ok I'll just get my Union represensitive then he turned round and said no it's ok forget about it then didn't bother following up his threat if he not done the managers course is he allowed to discipline anyone?

If he has not received training in the RM Conduct Code then he is not authorised to action a disciplinary.
