I'm on a stage one.
I have just worked 12 months without any sick. (I know i cant believe it either).
My previous interview was 3 months after my return to work. So I now been sick since and unfortunately triggered a stage 2.
They say its only 9 month since my last interview so thats when is starts from.
So is there a time frame that they have to do the interview when you return to work?
I've had one period of sick two days longer than allowed and he's issued a 2nd stage. No discression at all.

2. MINIMUM NATIONAL ATTENDANCE STANDARDS - EMPLOYEES NOT ON TRIAL
Employees who have successfully completed their trial period are still required to maintain a high standard of attendance. Attendance may be regarded as warranting formal action if an employee who is not on trial has:
Stage 1: 4 absences or 14 days in a 12 month period
Stage 2: 2 absences or 10 days in any 6 month period during the next 12 months
Stage 3: 2 absences or 10 days in any 6 month period during the next 12 months

mentions nothing about counting the interview or stage warnings into account so I think they should just extend the stage 1 for 12 months - or reissue it - however check with your rep and await answers on here.

It doesn't stop them trying.
They still try to count it from when the interview was. That's why they delay it so long.
I've had similar problems in the past, but luckily, they made a clerical error, which meant that I was let off. I didn't know that it was in black and white, that it should be from when you returned to work, not when they interviewed you. I just thought I had, had a lucky escape, I could have ended up with my secont RTU.
My first one, was after an accident at work. Which not surprisingly was their fault.

No, but there was less than 12 months gap between each interview. I had a lot of health problems at the time, which were subsequently sorted out.ROCKY wrote:if they count it from the interview were all your days off in a 12 month period backwards from that date
My RTU was caused, because I had been off for a while with a neck injury caused by an accident at work. Luckily my Union Rep managed to get them to accept that they had no right to penalise me, as it was their fault, not mine that I was injured.

your union rep should have made them put any subsequent ilness from last sick not the interview date. the time frame of 3 months is obserd and you should look at using the grievance procedure now. Ring your area rep tomorrow and get him to deal with it mate.dunposting wrote:I'm on a stage one.
