Restricted duties/return to work?

Post by Thunderthighs »

I've been off with an undiagnosed/unspecified virus and am awaiting Specialist/Consultants opinion/diagnosis. RM are taking about "Ill Health Retirement".
IF I am able to return to work...I would currently require light, indoor, segging, driving duties. Doctor/GP suggests even a small delivery is asking too much, currently.

SO...I've read that RM have an obligation to alter workloads, adjust duties, offer assistance etc...Am I able to suggest what I CAN POSSIBLY DO, rather than leave it to them?
We have someone who just does eve collections, which I was doing before they arrived, and would possibly be able to achieve this, plus indoor PHG and segging etc.

I can possibly return with this option, but...carrying a 9kg bag of mail, in torrential rain, up our version of Mt Everest is out of my reach....the moment.
Fingers crossed that a future/soon diagnosis and treatment "may" aleviate the condition I'm suffering with and get me back to some sort of normal RM workload.
Any advice or constructive comMents would be appreciated etc.
Thanks...

RM are wide as with DDA.

Basically oh assist have got to agree the condition is covered by DDA to make reasonable adjustments.

However,I'd check with union legal,if you have a condition covered by DDA in the eyes of medics and the law then it should be cool.

If your full time they will try and get you out sharpish.

Thunderthighs, download the booklet here

and have a good read to determine wether you come under the Equality Act or not.
This will decide your next course of action, so make sure you involve your rep asap.

For your information, the DDA was scrapped and replaced by the Equality Act in 2010.

As your condition is unspecified at present it would be difficult to get confirmation from OH Assist that this may be classified within the Equality Act 2010 until your specialist has provided report on your condition.
To be classed as having a disability outwith recognised conditions within the Equality Act basically you would have to prove that the condition has been known to you over a12 month period that has bee progressive and effects your ability to perform normal duties in a working environment and in your private life.
In the meantime after consultation with OH Assist they can provide a programme built into your condition and advise RM what your capabilities are and produce a workload that would be monitored by weekly rehabilitation meetings with your line manager until receipt of your specialist report.
The current climate within RM that they would probably not wait for a considerable length of time on your condition being assessed and opt for the easier option of ill health retirement.
